MOTION AS FOLLOWS:

Motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to
approve a variance of 3' from the required maximum height of a non-dwelling structure of
18' for an existing 40' by 48' steel building having a height of 21' with the condition
that Todd Simison and the contractor must meet with the Land and Resources Administrator to
review and to discuss the requirements of the Otter Tail County Shoreland Ordinance,
was noted that the structure is approximately 670' from the ordinary high water level, that
the structure is not view obstructing and that the structure is located in a commercial
area.

Dear Board Member,
In late August I went into ihe dock and lift business. To do this I needed at least 3 to 4
acres of land as close to the lake as possible.
I leased three and one half acres from Tom Hanson/'Zorbaz with the intention of
erecting a building on it. I looked for two weeks to find someone to build a building.
Evetyone was veiy busy due to the recent storm. Some contractors didn't even return my
calls. Others quoted astronomical prices.
After finding a contractor, I went to obtain a permit from Ottertail Covmty which was
granted. The clerk told me the building was to be 18'. I thought that meant 18' side walls
which I had planned. The total height of my building is 21' which is definitely over the 18'
mark.
I am applying for a variance around this as my building must be at least that tall to get a
boat lifr and canopy in the door. If I were to build the roof at a lesser pitch I would take
the chance of roof collapse as my previous roof did at Simison Marine.
I have a total of four men hired to work for me and also have quite a large investment at
stake here. I need to have your vote at the variance meeting in order to stay in business.

During the first part of the week of September 11, 1995, an individual (did
not give his name), came into the office for a Site Permit for a garage.
This garage was to be located on Zorba's property (the parcel where their
drainfield is located) across the road from Pelican Lake. At this time, he
provided a drawing showing the location of the proposed structure and the
existing drainfield. He indicated that there were two existing sheds
onsite, and as I requested, he drew them on the drawing.
After viewing the drawing, it appeared that the structure would meet the
setback requirements of the SMO. Therefore, I continued to complete a Site
Permit Application. As the Application was filled-in, I stated what was
being written down. Since there is not a box indicating the height of the
structure, I circled the 18'/1 story to verify the maximum height ("to the
peak") of the garage.
When I learned that the individual who came into the office, was not the
property owner, I informed him that the actual property owner, Thomas
Hanson, would have to be the one to sign the Application. At this time, he
took the completed Application and said that he would have him sign the
Application and return it to our office (he requested my name so he could
mail it to me) for processing. He asked how long it would take and
indicated that he would like it to be issued right away. I told him that I
would process the Application for him as soon as possible, that it was
already completed and all we needed was Mr. Hanson's signature and the
$50.00 fee (I kept the drawing with the file).
On September 15, 1995, the Application was received by this office (with
Thomas W. Hanson's signature) and the $50.00 Fee. I processed the Site
Permit.
