Hanzon Properties of Pelican Lake - Variance Application Denied (6:40 p.m.)
After consideration and discussion, Thomas Lee made a motion, seconded by Darren Newville to approve the
variance request, this motion failed. After additional discussion, Douglas Larson made a motion, seconded by
Michael Donoho and carried with Thomas Lee voting no to deny the variance to construct a tower feature being
24’ in height on the non-dwelling structure (Zorbaz Restaurant). This decision is also based on the Findings of
Fact and Decision Form, which contains the criteria reviewed and the Board’s finding have been attached to and
incorporated as an official part of the minutes which have been placed on file with the Land & Resource
Management Department.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: Improvements have been made to the structure this year and would like to
add the tower which will not impede any views and the septic system is also being updated. Add aesthetics to property and not take
anything away from it.

Staff Recommendation: Either approve or deny. If a motion is made to approve the application, staff recommends
the following conditions be included:

Shoreland Management Ordinance
Section 6, Subp. 5
All structures, except places of worship, nonresidential agricultural structures, and accessory structures
greater than 400 feet from the OHWL of a lake must not exceed the following height requirements:
A. A dwelling unit must not exceed a height of thirty-five (35) feet;
B. An accessory structure or a non-dwelling must not exceed a height of twenty (20) feet.
The height must be measured from the highest adjoining original ground level at the building foundation.
Staff Comments: Based on a review of the application and a site review. Staff offers the following comments:
1. Currently working with septic designer on measuring flow to establish a design flow. Once complete, a
system consisting of holding tanks will be designed.
SUMMARY OF VARIANCE
The reason for this variance permit is to request permission to construct a tower within the existing ;
structure with a height of 24’ The ordinance for structure height iimitation is 35’ for dweiiing structures
and 20’for non-dweiling structures. Zorbaz Restaurant as a non-dweliing structure has a height ^
limitation of 20’. A square ‘tower’ will be constructed within the existing footprint of the building to improve
the aesthetics and provide a focal point.
VARIANCE REQUEST CHECKLIST
1. Is the variance in harmony with the generai purposes and intent of the officiai controi? (The
board shall consider the purposes and intent of the official control).
Yes, the variance will allow the property owner to update a small portion of the existing building
both aesthetically and structurally. This construction project does NOT affect the percentage of
impervious surface area nor does it affect the seating capacity..
2. Is the property owner proposing to use the property in a reasonabie manner not permitted by
the official control? (The board shall consider what reasonable use of the property is lost (practical
difficulties) by the strict enforcement of the official control).
Yes, the use of the property will continue to be a restaurant and gathering place for members of
the community. No additional seating is being added.
3. Is the need for a variance due to the circumstances unique to the property not created by the
landowner or prior iandowners? (The board shall consider what circumstances are unique to the
property, such as lot size, lot configuration, wetland, steep slope, shore impact zone, bluff, floodplain,
floodway, etc. One or more should be stated on the record. What differentiates this parcel from others?

The variance request is a design feature that vyill enhance the property’s visual appeal for the
benefit of all patrons with no adverse effects to the surrounding neighborhood.
4. Will the issuance of the variance maintain the essential character of the locality? (The board
shall consider and state for the record why the request does or does not maintain the character of the
area. Is this request similar to what others have, what are near shore conditions of neighbors, similar
sized or number of structures adjacent or in area, etc.)
Yes, the character of the locality will not change from the existing conditions. Although not a
reason for the variance, the exterior aesthetics will be improved for the benefit of the locality.
5. Does the need for the variance involve more than just economic considerations? (The board
shall consider if economics played a role in the request. The fact that coming into compliance with the
ordinance requirements may cost considerably more does not constitute a practical difficulty).
The request for the variance is the owner being willing to invest in the upkeep and aesthetic
improvement of the property without harm or damage to any surrounding neighborhood.
ADDITIONAL CRITERIA
1. Whether the variance will secure for the applicant a right or rights that are enjoyed by other
owners in the same area.
The applicant has the goal of always being a good corporate neighbor and this variance request
is in line with that philosophy.
2. Whether existing sewage treatment systems on the property need upgrading before additional
development is approved.
The current sewage system is being metered and evaluated with input from the staff of the Land
& Resource Department. The plan is to completely update the system this fall based upon the
results of the evaluation and approval of the Department staff. This is a significant investment the
owner is willing to make in order to comply with County regulations. It is being done before the
system could fail in the future.
3. Whether granting the variance will be contrary to the public interest or damaging to the rights
or other persons or to property values in the neighborhood.
The granting of this variance request will not damage other property owners in the neighborhood.
The owner believes that this request is not contrary to the public interest, but is an enhancement.
4. No variance will be granted simply because there are no objections or because those who do
not object outnumber those who do.
