Dear Mr. Bench:
UNNAMED WATERCOURSE, SECTION 2 ’& 3, TOWNSHIP 131 NORTH, RANGE 41
WEST, OTTER TAIL COUNTY
As we discussed on August 9, 2007 by phone, no-DNR Division of Waters permit is necessary
for you to construct a water level control structure in Section 2 of Township 131 North, Range
41 West, as long as the structure DOES NOT EXCEED SIX FEET in height, as measured from
the stream bottom. The watershed area at this location is less than 300 acres, thus negating the
need for a DNR permit, if the heightTestriction is met.
This is still a protected watercourse. This exemption for this specific type of work DOES NOT
exempt this project from any requirement Otter Tail County Land & Resource may have for a
permit on this protected water.
Please accept my apology for the error I made which I hope has not delayed you.too long. It is
still my belief that someone other than the contractor or yourself who has design experience and
is qualified should do the design work for the structure in your best interest.
