Minnesota August 5,1999 Page 2 Dean Honrud - Approved As Requested Dean Honrud, Frazee, MN, requested a variance of 32’ from the required ordinary high water level setback of 100’ for the enlargement of both: a garage and a sunroom located 68’ from the ordinary high water level. The existing garage is 20’ by 34’ and the existing sunroom is 12’ by 12’. The applicant proposes to enlarge the garage to 24’ by 34’ and the sunroom to 16’ by 12’. Both proposals will meet all other setback requirements. The property is described as part of the westerly 500’ of Government Lot 5, lying between the lake and the road, Section 19 of Hobart Township by Long Lake. The audience was polled vvith no one speaking for or against the request. After consideration, motion was made by David Holmgren, second by Cecil Femling and unanimously carried, to approve a variance of 32’ from the required ordinary high water level setback of 100’ for the enlargement of both a garage and a sunroom located 68’ from the ordinary high water level as shown in the applicant’s drawing. Hardship is a small lot. It was noted that the proposed additions will be no closer than the existing structure and that the septic system is an approved system. Dean Jorgenson - Approved As:Requested Dean Jorgenson, Erhard, MN, request a variance of 50’ from the required ordinary high water level setback of 200’ for the construction of a 24’ by 30’ shop and for the construction of 28’ by 44’ dwelling, with an attached 30’ by 24’ garage, 150’ from the ordinary high water level. The property is described as part of Government Lot 5, Section 28 of Maplewood Township by Crystal Lake. A letter from Kevin and Diane Kugler expressing concerns with the location of the north property line was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, sec’ond by Cecil Femling and carried with Mark Steuart voting no, to approve a variance of 50’ from the required ordinary high water level setback of 200’ for the construction of a 24’ by 30’ shop and for the construction of a 28’ by 44’ dwelling with an attached 30’ by 24’ garage, 150’ from the ordinary high water level. Hardship is the unique shape of the applicant’s property with water on two sides and a state highway one of the remaining sides and the establishment of a new ordinary high water level. It was noted that the proposed locations for the proposed structures does meet the 200’ setback!for the majority of the lot and that adequate space is available for two on-site septic systems as has been determined by a licensed installer.: It was also noted that Kyle Westergard, Land and Resource | Department, assisted with the location of the 200’ setback and with the staking of the property and that he noted that the proposed locations are reasonable locations. The applicant also stated that the proposed shop would be at least if not more than 150’ feet from the ordinary high water level due to a change in the proposed location. Robert and Cynthia Davis - Approved As Requested Robert and Cynthia Davis, Wadena, MN, requested a variance to place a drain field less than 10’ from the lot line. From the applicants’ drawing it appears that the drain field will be approximately 2’ from|the lot line requiring a variance of 8’. The property is described as Lot 2, Block 1, Oak Shores Second Addition, Rush Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, second by David Trites and unanimously carried, to approve the variance as requested in the applicants’ application and drawing noting that the surrounding land does not accommodate another location and noting that the adjacent neighbor’s septic system is directly across the lot line.
