After additiona'i consideration, motion was made by Craig Anoerson. seconded by John Everts and carried with
Randall Mann abstaining, to approve the subdivision of the ex sting 2.42 acre parcel as per the plan submitted
by Mr. Berry 8i the April 7th, 1994 Board of Adjustment meeiing with the condition that a registered
surveyor's drawing will be provided at the time of recording. It should be noted that parcel three is reasonably
close to the required size for platted back lots on a general development lake. The granting of this variance
allows for the siraightening of property lines and provides a reasonable use of the property.
Mary Ann Tompkins - Approved
Mary Ann Tompkins, Minnetonka. MN, requested a varianoe o*' 120' from the required ordinary high water
level setback of 200' and a variance of 20' from the required shore impact zone setback of 100' for the
construction of a 12' by 36' addition to an existing structure approximately 80' from the ordinary high water
mark. The existing building line is being maintained. The property is described as the south 30' of
Government Lot 10 and all of Government Lot 11, Section 31 of Candor Township on Otter Lake. The applicant
was represented at the hearing by Dale Wussow, D&W Construction, Inc. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Carl Johnson, seconded by Cecil
Femlingand unanimously carried, to table the applicant's request until the April 7th, 1994 Board of
adjustment meeting for the purpose of determining if the granting of this variance request would have any
feet on the bluff impact zone or bluff setback requirements. The applicant was represented at the April 7th
.earing by Dale Wussow, D&W Construction, Inc. It has been determined that the property is not affected by a
bluff. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and carried with
Cecil Femling and Carl Johnson voting no and with Randall Mann abstaining, to approve a variance of 120' from
the required ordinary high water level setback of 200' and a variance of 20' from the required shore impact
zone setback of 100' for the construction of a 12' by 36' addition to an existing structure approximately 80'
from the ordinary high water mark. The addition will be no closer to the lake than the existing structure.
A. Krause - Approved
Edwin A. Krause, Faribault. MN, requested a variance of approximately 5' from the required 20' road right-
of-way setback for the construction of a 24' by 32' structure 15' from the road right-of-way. The property
is described as Lot 3, Block 2, Pioneer Acres, Rush Lake in Rush Lake Township. The audience was polled with
no one speaking for or against the request. The applicant requested prior to the meeting that his variance
request be tabled until the April 7th, 1994 Board of Adjustment meeting. After consideration, motion was
made by John Everts, seconded by Craig Anderson and unanimously carried, to table this variance request until
the April 7th, 1994 Board of Adjustment meeting. After cons deration, motion was made by Craig Anderson,
seconded by Cecil Femling and carried with Randall Mann abstaining, to approve a variance of 5' from the
required 20' road right-of-way setback for the construction of a 24' by 32' structure 15' from the road
right-of-way. The granting of this variance allows the applicant the same rights and privileges as his
neighbors.

John Ramacher - Withdrawn
John Ramacher, Maple Grove, MN, requested the following variances: 1.) minimum lot area be waived due to
lot size, 2.) ordinary high water level setback waived as bluff set back is more restrictive, 3.) a top of bluff
setback of 25' instead of the required 30' setback. A.) a road right-of-way setback of 1 5' instead of the
required 20' setback, and 5.) extend the maximum landing area to 50 square feet instead of 36 square feet.
The property is described as Lots D and E, Lillis Survey Plat of Government Lot 2. Dead Lake in Dead Lake
Township. Letters opposing the granting of this variance request from the following were read for the record:
Michael Schantzen, Ernest and Rhea West and the Dead Lake Property Owners Association. The audience was
polled with James Salness expressing the concerns of the Dead Lake Property Owners Association. After
consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to table
the applicant's request until the April 7th, 1994 Board of Adjustment meeting for the purpose of obtaining
additional measurements. After additional consideration the applicant has decided to withdraw his request.
Don R. Plombon - Withdrawn
Don R. Plombon, 5t. Cloud, MN, requested a variance of 25‘ from the required ordinary high water level
setback of 75' for the location of a dwelling 50' from the ordinary high water level. The property is described
as Lot 9, Block 2, Pleasure Park, Otter Tail Lake in Otter Tail Township. The applicant requested prior to the
meeting that his variance request be tabled until the April 7th, 1994 Board of Adjustment meeting. After
consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to table
this variance request until the April 7th, 1994 Board of Adjustment meeting. After additional consideration
the applicant has decided to withdraw his request.

Daniel Lyle and Cheryl Ann Gleesing, St, Cloud, MN, requested one of the following variances: 1.) a variance of
2' from the required south side lot line setback of 10', 2.) a variance of 2' from the required 20' road right-
of-way setback or 3.) a variance of 1' from the required side lot line setback of 10' and a 1' variance from the
required 20' road right-of-way setback. The applicants have a 50' wide lot and wish to replace an existing
structure with a 22' wide dwelling. The applicants indicated that they have engaged a surveyor and will have
additional measurements available regarding the relationship of their lot to the township road. The property is
described as part of Government Lot 5, Section 34 of Girard Township on West Battle Lake. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by John Everts and unanimously carried, to table the applicants’ request until the April
7th, 1994 Board of Adjustment meeting, so that consideration can be given to a variance request that has been
submitted by Warren Dalen, an adjacent property owner of the Glessings, and is scheduled to be heard at the
April 7th, 1994 meeting. If Mr, Dalen's request is granted the Glessings will no longer require a variance.

Merle Eugene Kersten, Kiowa, K$, requested a variance from the bluff impact zone and a variance from the top
of bluff setback requirements for the construction of a 14' extension to an existing deck and for the addition of
a chair lift. The property is described as Lot 15, Block 1, Otter Tail Lakeview Heights, Otter Tail Lake in
Otter Tail Township. The audience was polled with Dolores Scott speaking in favor of this variance request.
After consideration and discussion, motion was made by Craig Anderson, seconded by Cecil Femling and carried
with John Everts voting no, to allow the chair lift with the condition that there be no extension towards the
lake of the existing main dwelling deck.
Marie E. Slechta - Approved

Mane E. Slechta. Dent, MN, requested a variance to subdivide from an existing 45,05 acre parcel, by metes
and bounds descriptions, an approximately 1.5675 acre parcel into ten substandard backlots which will be
permanently attached to platted lots in Hunter's Beach and Ted's Beach. The ordinance permits the development
of backlots of no less than 5,000 square feet if they are legally joined to a lakeshore parcel. contain permanent
restrictions against residential construction, and are created by a subdivision plat In such a manner as to allow
for orderly attachment to lakeshore parcels. The property is described as part of Government Lots 1 and 2.
Section 13 of Star Lake Township on Star Lake, The applicant was represented at this hearing by Robert L.
Russell, Attorney. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Carl Johnson, seconded by Craig Anderson and unanimously carried, to
approve the variance as requested by the applicant, including parcel one which has 4,087 square feet of area,
with the provision that all documents transferring title of these backlots to the appropriate property owners
of the platted lake lots in Hunter's Beach and Ted's Beach be presented at the same time for recording.

Charles W. and Wendy M, McKnight, Batavia, IL, requested a variance of approximately 5' from the required
1 O' side lot line setback for the construction of a 24' by 22’ garage 5' from the side lot line. The property is
described as part of Government Lot 3, Section 15 of Eagle Lake Township on Eagle Lake. The applicant was
represented at the hearing by Dean Kapphahn. The audience was polled with Marlys A. Klimp speaking against
the granting of the variance request. After consideration, motion was made by Craig Anderson, seconded by
Cecil Femling and unanimously carried, to approve a 1' variance from the required 10’ side lot line setback for
the construction.of a.24' by 22' garage 9’ from the side lot line and being no closer to the lake than the existing
dwelling.
