A letter from Gary and Corinne Schattschneider opposing the applicant’s request was read for the record. After consideration and discussion, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve a variance of 75’ from the required ordinary high water level setback of 200’ for the construction of a dwelling 125’ from the ordinary high water level of Rusch Lake with the condition that measures must be taken to prevent erosion into the lake during the construction period. Hardship is a substandard lot of record. Jill Annette Langren - Approved Jill Annette Langren, Battle Lake, MN, requested a variance of approximately 10’ from the required road right-of-way setback of 20’ for the construction of a 24’ by 24’ garage located approximately 10’ from the road right-of-way. The property is described as Lot 6 and the northeasterly 10’ of Lot 7, Martee Beach, Blanche Lake in Everts Township. The applicant was represented by her parents at the public hearing. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a variance of 10’ from the required road right-of-way setback of 20’ for the construction of a 24’ by 24’ garage located 10’ from the road right-of-way. It was noted that this is not a very heavily travel road and that the placement of the garage in this location is perhaps the best location since the applicant’s front lot is very shallow and the applicant’s back lot contains a wetland area. /Catherine Ann Belmont - Denied Catherine Ann Belmont, Ottertail, MN, requested a variance “to build a garage to match the pitch of our present home which would make it 22’ 7” high. We would also like to tie our rooflines together with an open breezeway. Most crucial would be the height. We would like to maintain the same pitch to the roof on the garage as our home. Instead of having the setback of 10’ we would increase it to 12’. The garage would be 24’ by 36’ (with a 12/12 pitch by 22’ 7’’.” The property is described as Lot 13, Block 1, Paulson’s Timberlane Addition, Buchanan Lake in Rush Lake Township. The audience was not polled at this pubic hearing as the variance request was originally heard at the July 10, 1997 meeting, at which time it was tabled until the August 7, 1997 meeting to allow the applicant an opportunity to consider other alternatives. The applicant was not in attendance at the August 7, 1997 meeting; therefore, no action was taken concerning the applicant’s request. As of the August 14, 1997 meeting, the applicant had not contact the office to discuss the tabling of her request until a further date, therefore, after consideration a motion was made by George Walter, seconded by John Everts and unanimously carried, to deny the variance as request for failure oHhe applicant to appear at the public hearing. With no further business Chairman Walter declared the meetings of August 7, 1997 and August 14, 1997 adjourned. OuzfzW.OTj?ja Wayne S , Secretary ^ v« ***^ f July 10, 1997 Page 4 Lee Marquardt - Approved Lee Marquardt, South Haven, MN, requested a variance to subdivide a 1.6 acre parcel from an existing 5.5 acre parcel. The property is described as Tract 9, Crystal Hills Fifth Addition (A.K.A. Auditor’s Subdivision #108) and part of Government Lots 3 and 4, Section 11 of Lida Township by Crystal Lake. Wes Tweeton represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to approve the subdivision of a 1.6 acre parcel from an existing 5.5 acre parcel with the condition that a registered surveyor’s drawing must be presented when the subdivision is recorded. Catherine Ann Belmont-Tabled Catherine Ann Belmont, Ottertail, MN, requested a variance “to build a garage to match the pitch of our present home which would make it 22’ 7” high. We would also like to tie our rooflines together with an open breezeway. Most crucial would be the height. We would like to maintain the same pitch to the roof on the garage as our home. Instead of having the setback of 10’ we would increase it to 12’. The garage would be 24’ by 36’ (with a 12/12 pitch) by 22’7”. “ The property is described as Lot 13, Block 1, Paulson’s Timberlane Addition, Buchanan Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by John Everts and unanimously carried, with the written permission of the applicant, to table the applicant request until the August 7, 1997, meeting, to allow the applicant an opportunity to consider the requirements for attaching the proposed garage to the existing dwelling by a breezeway. Gary Richard Erdmann - Approved Gary Richard Erdmann, Oxbow, ND, requested a variance of approximately 168’ from the required ordinary high water level setback of 200’ for the placement of the east corner of the porch approximately 32’ from the ordinary high water level and a variance of approximately 158’ from the required ordinary high water level setback of 200’ for the placement of the west corner of the porch approximately 42’ from the ordinary high water level. The applicant will be moving an existing dwelling from Lot 25 to Lot 24. If the variance is approved the existing porch and slab on Lot 24 would be removed. The property is described as Lots 23, 24 and 25, Block 1, Brightwood Shoreline, Dead Lake in Star Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve a variance of 150’ from the required ordinary high water level setback of 200’ for the development of Lot 24, Brightwood Shoreline. Hardship is a substandard lot of record. 'I July 10, 1997 Page 3 Eldon and Lorraine Graf - Approved Eldon and Lorraine Graf Estates, C/O Beverly Beske, Dalton, MN, requested a variance of approximately 20’ from the required ordinary high water level setback of 75’ for a 7’ by 28’ addition to the lake or north side of an existing cabin being approximately 55’ from the ordinary high water level. The property is described as Lot 25 and a 25’ by 150’ tract along the East Side of and adjacent to Lot 25, Wall Lake Point, Wall Lake in Dane Prairie Township. The audience was polled with Alfred Hensch speaking to the request. After consideration and discussion, motion was made by John Everts, seconded by Randall Mann and carried with Cecil Femling and Randall Mann voting no, to approve the variance as requested noting that due to an 8’ jog in the closest corner of the neighbor’s dwelling the proposed addition would be ahead of the string line as traditionally established, but the proposed addition would actually be a few inches behind the front of the neighbor’s dwelling or what would be considered the building line. The granting of the variance will line up the building. It was noted that the septic system appears to be sufficient for the proposed development. Hardship is the unique shape of the adjacent neighbor’s dwelling. Ronald Albrecht - Withdrawn Ronald Albrecht, Fargo; ND, requested a variance of approximately 8’ 6” from the required side lot line setback of 10’ and a variance of approximately 3’ from the required septic tank setback of 10’ for the construction of a 20’ by 22’ garage approximately T 6” from the side lot line and approximately 7’ from the septic tank. The property is described as part of Lot 5, Crystal-Lida Beaches Subdivision of Lot 9, Block 2, Lake Lida in Lida Township. The audience was polled with no one speaking for or against the request. After much discussion and consideration, the applicant decided to withdraw his variance application and to considered other building and remodeling alternatives. Walter J. Seifer - Denied Walter J. Seifert, Perham, MN, requested “a variance to allow rock and stabilization materials, including trees and shrubs, to be placed in a bluff impact zone.” The property is described as the North 50’ of Lot 9 and all of Lot 10, Twin Oak Heights, Big Pine Lake in Pine Lake Township. Terry A. Karkela, Attorney, appeared along with the applicant at the public hearing. Letters from the following were read for the record: Bruce Becker, District Conservationist with the Perham Field Office, Jerry Neseth, and Terry Lejcher, Area Hydrologist with the Department of Natural Resources. After much discussion and consideration, motion was made by Craig Anderson, seconded by Cecil Femling and carried with Robert Schwartz voting no, to deny the variance as requested as no adequate hardship had been shown and it is the recommendation of the Department of Natural Resources that this area should not be disturbed due to its fragile nature. Johnson and Canfield - Approved Johnson and Canfield, C/O Eric W. Canfield, Cumberland, Wl, requested a variance to subdivide, by metes and bounds description, a 4.8-acre parcel from an existing 33.34-acre parcel. The property is described as the South 1,100’ of Government Lot 7, Section 29 and Sub Lot 1 of Government Lot 6, Section 30 of Edna Township by McDonald Lake. Terry Freeman, Landecker and Associates, Inc. represented the applicants at the public hearing. After consideration, motion was made by Craig Anderson, seconded by George Walter and unanimously carried, to approve the subdivision of a 4.8 acre parcel, by metes and bounds description, from an existing 33.34 acre parcel with the condition that a road meeting township specifications and dedicated to the public must be constructed before the recording of the 4.8 acre subdivision will be permitted and with the condition that a registered surveyor’s drawing must be provided at the time of recording. 7^/cr 97- Re<u “7- < V ;•! i !
