It was noted that the applicants have a very shallow lot and amending the previously granted variance would not establish precedence for this immediate area. Minnesota July 9, 1998 Page 2 Kristopher and Teresa Anderson - Approved Kristopher and Teresa Anderson, Dilworth, MN, requested a variance to amend the variance of September 2, 1993 to allow the placement of a structure 2’ closer to the ordinary high water level than previously granted. On September 2, 1993 a variance was granted to approve the construction of a structure, not exceeding 30’ in width, 20’ from the road right of way. The previously granted variance would have placed the structure approximately 50’ from the ordinary high water level. The applicant’s are proposing an ordinary high water level setback of approximately 48’. The property is described as Lot 15, St. Lawrence Beach, Rush Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Randall Mann, and carried with Cecil Femling voting no, to approve a variance to amend the previously granted variance of September 2, 1993 by allowing for the placement of a structure 48’ from the ordinary high water level or 2’ closer than the previously approved setback of 50’. Bradley James Russell - Denied Bradley James Russell, Fergus Falls, MN, requested a variance of approximately 20’ from the required ordinary high water level setback of 100’ for the placement of an RV no closer than 80’ from the ordinary high water level. The property is described as Lot 4, Timberlane Beach Rearrangement, Round Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Dick Sha and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. The applicant has a very large lot with other suitable sites for the placement of a dwelling unit that would not require a variance. Diane Trimbo - Denied Diane Trimbo, Minneapolis, MN, requested a variance of 50’ from the required ordinary high water level setback of 200’ for the construction of a 30’ by 56’ pole shed 150’ from the ordinary high water level. The property is described as Lot 2, Block 1, Meadow Ridge Estates, Johnson Lake in St. Olaf Township. Clem Hendrickson, Surveyor, appeared along with the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by John Everts and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and noting that a 30’ by 56’ storage building exceeds a reasonable use for this property. It was also noted that Meadow Ridge Estates is a recent plat, which should have adequate room for building development that does not require a variance. System design must be to scale and must include the proposed location of the sewage system, all existing/proposed buildings, property lines, the ordinary high water level of the water body and all water wells within 150' of the sewage system.
