the required setback is 75'. We also request a variance for the Shore Impact Zone Impervious Surface
Coverage as we will increase the coverage by 206 sq. ft. for a total of 1,276 sq. ft. coverage in the Shore
Impact Zone. Please note that our lot is a substandard lot of record created in 1969 which makes it
difficult to make improvements without a variance.

After consideration and discussion, Douglas Larson made a motion seconded by Darren New\'ille and carried
by roll call vote to deny the variance request as the proposed project is to close to the lake and concerns with
blocking neighbors’ views. This decision is based on the Findings of Fact and Decision Form, which contains
the criteria reviewed and the Board’s finding have been attached to and incorporated as an official part of the
minutes which have been placed on file with the Land & Resource Management Department.

Requested Variance: We desire to expand the existing patio and construct a screened porch. The screen porch will be
approximately 33' from the ordinary high-water level as measured by Land & Resource Management, the required

Ordinance Section Citation: III. 4. A., IV. 8. B. and IV. 12.
A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: Provide a screen porch as their parents will be moving in and are both in
wheel chairs and by placing the enclosed screen porch in this location which has a sliding door that will allow wheel chair access to
the proposed screen porch. This is also no closer to the lake than the existing.

The intent of the ordinance is to maintain the distance from the structure and the required setbacks. The increase of
impervious surface in the shore impact zone with the proposal when there is already issues with ice damage.

record why the request does or does not maintain the character of the area. Is this request similar to what others have, what are
near shore conditions of neighbors, similar sized or number of structures adjacent or in area, etc.)

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

Kelly & Jill Geiger. Lot 7 - Broadwater Beach 2"^ Addn.. Pelican Lake (56-786) in Dunn Due to the substandard size of the lot w e are
requesting to be at 33% building + other impervious surface versus the required 25%. The lot currently has an old. defunct garage that
violates various setback ordinances and is the eyesore of Broadwater Drive and we would like to upgrade. Due to location of the septic
we are requesting to be 14ft from road right of way versus the required 20 ft. Due to location of septic we are requesting to be 6 ft
away from septic holding tank versus the required 10 ft.
Kelly Geiger, property owner represented the variance application via GoToMeeting. The audience was polled with no one speaking
for or against the variance application.
After consideration and discussion. Darren New ville made a motion, seconded by Michael Donoho and carried by roll call vote to
approve the variance request to replace the existing detached garage being 14 feet from the road right of way and 6 feet from the
holding tank w ith the condition that the existing impervious surface coverage cannot exceed the current impervious surface coverage
of 27.41%. This decision is also based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the
Board’s Finding have been attached to and incorporated as an official part of the minutes w hich have been placed on file with the Land
& Resource Management Department.

Required for projects within the Shore Impact Zone only.
List & Identify all existing and proposed onsite shore impact zone impervious surfaces on the scale drawing.
Land located between the OHWL of public water and a line parallel to it at a setback of 50% of the structure setback
(see Section III 4 ), but not less than 50 feet. For Ag land the SIZ is 50 ft. from the OHWL (see Section IV.4.).
