After consideration and discussion, Paul Larson offered the following motion, which was seconded by Thomas Lee and unanimously carried, to
approve development as proposed in the variance application dated November 23, 2016 and as depicted in the drawing submitted with the
application with the condition that dwelling must be placed 75’ from the ordinary high water level and with the' condition that the deck
extend no more than 8’ towards the lake (deck must be 67’ from the ordinary high water level). The variance ds approved does not directly or
indirectly grant any other variances for the proposed development. The proposed development must meet all other setback requirements.

Thursday, March 9, 2017
The Otter Tail County Board of Adjustment met Thursday, March 9, 2017, with the following persons in attendance:

Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the December 8, 2016 meeting as mailed.
Chair and Vice Chair Selection -
Steve Schierer, 2016 Chair, called for nominations for Chair of the 2017 Board of Adjustment. Paul Larson made a motion,
second by Thomas Lee and canded with Steve Schierer voting no, to direct the Secretary of the Board of Adjustment to cast a
unanimous ballot for Steve Schierer as Chair of the 2017 Board of Adjustment.
Steve Schierer, 2017 Chair, then called for nominations for Vice - Chair of the 2017 Board of Adjustment. Steve Schierer made a
motion, second by Paul Larson and unanimously carried, to direct the Secretary of the Board of Adjustment to cast a unanimous
ballot for Thomas Lee as Vice - Chair of the 2017 Board of Adjustment.
The Board of Adjustment considered the following applications for variance:
Kevin and Jami Haugstad - Approved Variance Request No. I and Denied Variance Request No. 2. (6:32 p.m.)
Kevin and Jami Haugstad, Lot 6 Block 1 Stalker Lake Golf View Shores, Stalker Lake in Tordenskjold Township, requested the
following: 1.) The existing water-oriented accessory structure has a setback from the bluff of 25 - 27’ (ordinance requirement is
30’) and 2.) We would like to build a retaining wall within the bluff zone, (similar to a nearby neighbor that built one a few years
ago) that will help prevent future soil erosion on the bluff, which has been occurring for many years. The audience was polled
with no one speaking for or against the variance as requested. The application was represented by Kevin Haugstad and Lavonn
Haugstad. A letter from Todd and Dawn Caven in support of the applicants’ request was read for the record. After consideration
and discussion, Rick Wilson offered the following motion, which was seconded by Darren Newville and unanimously carried, to
approve the location of the existing water-oriented accessory structure, which is currently setback 25 to 27’ from the top of the
bluff and to deny the variance as requested for the construction of a retaining wall within the bluff zone. It was the general
opinion of the members of the Board of Adjustment that constructing a retaining wall within the bluff zone could cause greater
damage/erosion to the property and that it would be best not to disturb the natural vegetation. It was noted that the local Soil and
Water Conservation District offices can assist with the development of a plan to help reduce and eliminate erosion within the
bluff without disturbing the natural vegetation. The approval of the water-oriented accessory structure location was based on the
pre-existing platform and the cost associated with moving the structure back those few feet as compared to the benefit that would
be received by moving the structure back. The variance as approved does not directly or indirectly grant any other variances for
the development as proposed.

Bruce A. Brown, Lot 14 Block 3 Miller Beach, Round Lake in Rush Lake Township, requested the following: Building Setback:
Current structure 62’ from shoreline. Current deck is 54’ from shoreline. Building a new structure, would like to use the current
footprint and setback. Old structure 36’ by 34’ (less front and back decks). New structure expand footprint (36’ by 62’). The
new structure will maintain the 62’ setback from shoreline. The front deck from the old structure will be removed and replaced
with a new deck extending the length of the new structure of 62’. Would still maintain the cuiTent setback of 54’ to shoreline.
The back deck from the old structure will be removed and not replaced. The 8’ by 8’ shed will be removed and not replaced. The
application was represented by Foster and Lora Strand. The audience was polled with no one speaking for or against the variance
as requested.

After consideration and discussion, Paul Larson offered the following motion, which was seconded by Thomas Lee and
unanimously carried, to approve development as proposed in the variance application dated November 23, 2016 and as depicted

level and with the condition that the deck can extend no more than 8’ towards the lake (deck must be 67’ from the ordinary high

Dennis and Corlys Carlblom - Variance application approved as requested with conditions. (6.59 p.m.)
Dennis & Corlys Carlblom, Lot 4 Oak Haven Beach and Lots 5 and 6 Olson’s Oak Haven Subdivision, Tamarac Lake in
Scambler Township, requested the following; Lots 5 and 6 of Olson’s Oak Haven Subdivision are permanently attached to Lot 4
of Oak Haven Beach. I propose to detach Lot 5 of Olson’s Oak Haven Subdivision from Lot 4 of Oak Haven Beach and
permanently attach Lot 5 to Lot 3 of Oak Haven Beach with a transfer of ownership of Lot 5 to the owners of Lot 3, Chad D.
Carlblom and Kristen L. Carlblom. The application was represented by Dennis Carlblom. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Darren Newville offered the following
motion, which was seconded by Rick Wilson and unanimously carried, to approve the detachment of Lot 5 Olson’s Oak Haven
Subdivision from Lot 4 Oak Haven Beach with the condition that Lot 5 Olson’s Oak Haven Subdivision must be permanently
attached to Lot 3 Oak Haven Beach and with the condition that Lot 6 of Olson’s Oak Haven Subdivision must remain
permanently attached to Lot 4 Oak Haven Beach. It was noted that the original intent of the lots in Olson’s Oak Haven
Subdivision was for permanent attachment to the lake lot directly across the road. The approval of this request is consistent with
past actions of the Board of Adjustment and is in agreement with the original intent of Olson’s Oak Haven Subdivision. The
variance as approved does not directly or indirectly grant any other variances for future development of these properties.
Kelly and Michelle Klostcrman - 'Variance application approved as requested with conditions. (7:03 p.m.)
Kelly & Michelle Klosterman, a metes and bounds parcel in the rear of Lots 16 tlirough 19, Eldorado Beach, Otter Tail Lake in
Amor Township, requested the following: Proposing to split off a 120’ by 181.5' piece to be pemianently attached to Parcel No.
02000230179000. The proposed split is on the non-riparian portion of the lot. The remaining 120’ by 181.5’ will stay with the
riparian Lots 16 and 17. Parcel No. 02000230178000. The proposed use will be nonresidential. Currently there is a shed and a
lean to shed, which will be removed no later than August of 2018. Both non-riparian lots will be buildable for nonresidential
purposes. The application was represented by Kelly Klosterman. The audience was polled with no one speaking for or against the
variance as requested. After consideration and discussion, Paul Larson offered the following motion, which was seconded Rick
Wilson and unanimously carried, to approve the proposed subdivision as described in the variance application dated February 14,
2017 and as depicted on the drawing submitted with the variance application with the condition that the existing structures
described in the application for removal must be removed on or before September 30, 2017 and a registered surveyor’s drawing
must be provided at the time of conveyance. It was noted that the two back lots will be permanently attached to lake lots directly
across the highway and the backlots will be used for nonresidential development.
Thomas Holdeman - Variance application approved as requested with conditions. (7:10 p.m.)
Thomas Holdeman, part of Government Lot 5, Section 28 of Maplewood Township by Crystal Lake, requested the following:
We are requesting to subdivide the existing parcel of 4.29 acres into two parcels. Parcel B1 to be approximately 2.57 acres and
Parcel B2 to be approximately 1.72 acres. Both parcels are for single family residential use. Access to both parcels will be
provided by existing recorded easements. The application was represented by Thomas Holdeman, Cyndy Gustafson and Becky
K. (not sure of the spelling for the last name). The audience was polled with no one speaking for or against the variance as
requested. A letter from H. Dean and Delores Jorgenson in support of the applicant’s request was read for the record. After
consideration and discussion, Steve Schierer offered the following motion, which was seconded by Thomas Lee and unanimously
carried, to approve the proposed subdivision with the condition that the parcel identified on the drawing submitted with the
variance application as Parcel B#2 must have at least 80,000 square feet of area, both Parcel B#1 and Parcel B#2 must have
recorded easements for ingress and egress to each of the respective parcels as necessary, a registered surveyor’s drawing must be
provided at the time of recording and Parcel B#1 must have at least 200’of lakefront and lot width at the required building
setback. It was noted that the additional square footage necessary for Parcel B#2 to reach 80,000 square feet can come from
proposed Parcel B#1 or from Parcel A (adjacent to the east and north side of proposed Parcel B#2). The variance as approved
does not directly or indirectly grant any other variances for the proposed or future development of these two parcels.

Dear Mr. Brown;
Enclosed herein please find your returned Variance Application along with your check and your
drawings. 1 am returning the Variance Application to you because there needs to be a little clarification
on your request.
You stated that the “Current Structure is 62’ from shoreline. Building a new structure. Would like to
use the current footprint and setback”. In reviewing your drawings it looks like you are expanding

You win want to be a little more specific in your request in stating that you are expanding beyond the
existing footprint with the proposed new dweUing (36’x62’) and also constructing a deck. The deck
needs to meet setbacks also and if it does not meet setbacks it needs to be a part of your Variance
request as well. You will need to indicate the distance that the deck is to the lake.
