The Board of Adjustment considered the following applications for variance: Michael J. and Debra S. Ternus - Denied (6:32 p.m.) Michael J. and Debra S. Ternus, Lot 1 Arts North Shore, Lot 7 Block 1 Arts North Shore Second Addition and part of Government Lot 1, Section 5 of Rush Lake Township by Marion Lake, requested the following; Total height is 39’ 6” on structure. We are requesting a variance of 4’ 6”. Maximum height is 35’ on structure for this lot. The applicants’ site contractor appeared at the public hearing with the applicant (Michael Ternus). The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, seconded by Jack Rosenthal and unanimously carried, (Request No. 1) to allow the building impervious surface to exceed the 20% requirement by 4.1%, (Request No. 3) to allow the setback from the ordinary high-water level to be less than the 50’ requirement by 5’ as determined when applying the string line for house placement and (Request No. 2) to allow other impervious surface and building to exceed the 25% requirement by 5% for total impervious surface coverage not to exceed 30%. Hardship/practical difficulty is a very substandard lot of record. The variances as granted will provide the applicant with the ability to enjoy the same rights and privileges as others in this immediate area. It was noted that the proposed development is like other development within the immediate area. I'he variances as approved do not directly or indirectly grant any other variances for the proposed or future development of this property.
