OTTER TAIL COUHTY BOARD OF ADJUSTHEHT
October 13th, 1994
The Otter Tail County Board of Adjustment met Thursday, October 13th, 1994, with the
following persons in attendance:
Craig Anderson
John Everts
Cecil Femling

CALL TO ORDER - The meeting was called to order at 7:00 p.m. by Chairman George Walter.
MINUTES APPROVED - OCTOBER 6TH, 1994
Hearing no corrections or additions the minutes of the October 6th, 1994 meeting were
declared approved as mailed.
The following variance requests were heard:1
Andy Formo - Ho Action ii■;Andy Formo, Fergus Falls, MN, requested a variance of 5* 6* from the required holding tank
setback of 10' for the location of a new garage 4' 6* from the holding tank. The property
is described as Lot 9, Fleming Patterson Beach, Swan Lake in Dane Prairie Township. The
audience was polled with no one speaking for or against the request. After consideration,
motion was made by Randall Mann, seconded by Carl Johnson, to approve the variance as
requested. The motion failed with John Everts, Craig Anderson and George Walter voting
no. After additional discussion and upon the recommendation of Wally Senyk, County
Attorney, the Board of Adjustment took no additional action regarding the variance
request. It was noted that there had not been any significant changes since the Board
granted a variance on' August 4th, 1994, and that any noncorapllance with the variance
granted on August 4th, 1994, would need to be resolved by the Land and Resource Office
and/or the County Attorney's office.
Loretta M. Mllander - Denied
Loretta M. Milander, Watertown, MH, requested a variance of 10' from the required side lot
line setback of 10' for the location of a 10' by 20' temporary carport. The carport roof
extends to the lot line. The property is described as Lot 6 and adjacent 30' of Lot 7,
Kleins Beach, Marion Lake in Rush Lake Township. A letter from George J. Sliva in favor
of the variance request was read for the record. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by George
Walter, seconded by Craig Anderson and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown.

Leo Harnon - Approved
Leo Harmon, Ottana, IL, requested a variance of 150' from the required ordinary high water
-level setback of 200' and a variance of 50' from the required shore Impact zone setback of
100' for the construction of a 28' by 40' dwelling 50' from the ordinary high water level
and a variance of 75' from the required ordinary high water level setback of 200' for the
construction of a 28' by 28' garage approximately 125' from the ordinary high water level.
The property is described as part of Government Lot 8, Section 25 of Dead Lake Township on
Dead Lake. Sandy Morton represented the applicant at the hearing. Letters from Michael
and Sandra Doyle, Ward Emerson, and Dennis and Mary Wilkes were read for the record. The
audience was polled with no one speaking for or against the request. After consideration,
motion was made by Craig Anderson, seconded by Cecil Feraling and unanimously carried, to
approve a variance of 150' from the required ordinary high water level setback of 200' and
a variance of 50' from the required shore impact zone setback of 100' for the construction
of a 28' by 40' dwelling 50' from the ordinary high water level and a variance of 75' from
the required ordinary high water level setback of 200' for the construction of a 28' by
28' garage approximately 125' from the ordinary high water level. Hardship being a
substandard lot of record and the unique layout of the lots. It was noted that the
applicant's request is consistent with other development in the area and is within the
building line.
Jerry L. and Diane K. Begley - Denied/Approved
Jerry L. and Diane K. Begley, Battle Lake, MN, requested a variance of 60' from the
required ordinary high water level setback of 100' and a variance of 10' from the required
shore impact zone setback of 50' for the construction of a 10' by 22' three season porch
40' from the ordinary high water level. The property is described as part of Government
Lot 3, Section 26 of Tordenskjold Township on Stalker Lake. The audience was polled with
no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, seconded by Randall Mann and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown and other alternatives exist. After
additional consideration, motion was made by Craig Anderson, seconded by John Everts and
carried with Randall Mann voting no, to grant a variance from the side lot line setback
for a water - oriented accessory structure meeting all other ordinance requirements for
water - oriented accessory structures with the condition that the existing shed as shown
on the applicant's drawing must be removed and with the condition that the water -
oriented accessory structure can extend no more than 10' in front of the existing
dwelling.
Earl J. Seibold - Approved
Earl J. Seibold, Fargo, ND, requested a variance of 11' from the required top of bluff
setback of 30' for an addition to an existing structure 19' from the top of the bluff.
The property is described as Survey Lot 6, part of Government Lot 1, Section 26 of Lida
Township on Lake Lida. The audience was polled with no one speaking for or against the
request. A letter from Timothy A. Boock in favor of the variance request was read for the
record. After consideration, motion was made by Carl Johnson, seconded by Craig Anderson
and unanimously carried, to approve a variance of 11' from the required top of bluff
setback of 30' for an addition to an existing structure 19' from the top of the bluff with
the addition will not have a basement, the runoff will bethe following conditions:
directed towards the rear of the lot and away from the lake and that pillar constructionIt was alsoHardship being a substandard lot of record.will be used for the addition,
noted that the applicant would be behind the building line and that the applicant has
already done a very good job of stabilizing the bank.
