It was noted that the width and area of both parcels exceed the minimum requirements for platted lots on a general development lake. It was also noted that each parcel does have access to a public road. One parcel would be approximately 1.8 acres and the other parcel would be approximately 4.82 acres. The minimum size requirement for unplatted parcels within the shoreland area is 5 acres. The property is described as part of Government Lot 3, Section 7 of Rush Lake Township on Marion Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance to subdivide a parcel of 1.8 acres frotn an existing 6.62 acre parcel with the condition that a registered surveyor’s drawing must be presented at the time of recording. Kenneth Ludeaann Denied Kenneth Ludemann, Fargo, HD, requested a variance to enclose an existing deck located 90’ from the ordinary high water level, 62’ from the East side lot line, 64’ from the West side lot line and having a height of approximately 12’. The existing deck is located in the bluff zone. The property is described as Lot 16, Silent Haven, West Silent Lake in Dora Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Leslie Estes and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and concern was expressed with erosion that might occur as a result of construction in the bluff zone. It was noted that the granting of this variance request would establish a precedence. , Dean R. Slotten - Tabled Dean R. Slotten, Fargo, ND, requested a variance of approximately 38’ from the required ordinary high water level setback of 100’ for the construction of a 30' by 60’ structure approximately 62' from the ordinary high water level. The property is described as Lot 1, Block 1, Walida Heights, Big McDonald Lake in Edna Township. The audience was polled with no one speaking for or against the request. After consideration, motion as made by Craig Anderson, seconded by John Everts and unanimously carried, to table the variance request until the November 2nd, 1995, meeting to allow the Land and Resource Department an opportunity to determine if the applicant’s property is affected by a bluff.
