(7:08 p.m.) Sheila Carney, Lot 1 Block 2 Engstrom Beach, Big McDonald Lake in Edna Township, requested the following: We are requesting a variance of 50’ from the 100’ waterfront setback for the construction of a patio and cabana on a project which started construction in the fall of2016. The variance and subsequent permit in 2016 was approved for a building line at 50’ from the ordinary high-water line and included a patio layout that was almost identical to the current design, however, the initial design did not include the cabana as a part of the patio which is the reason for the variance request. The cabana is plamied to be constiucted in compliance with the Shoreland Ordinance building requirements for accessory structures. Mike Dozen represented the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve the variance as described in the variance application dated December 21, 2017 and as depicted on the drawing submitted with the variance application. It was noted that the proposed development will be at least 20’ from the road right-of-way and will be no closer to the ordinary high-water level than the house. It was also noted that the variance requested for the proposed development is consistent with a previously granted variance. New structure will be a 2-story structure. All new construction will not be any closer to the lake, approximately 32’ and will maintain the 5’ lot line setback. We are requesting for the lot line setback to be at 10' because the lot has room for that allowance. The cabin originally contained a three season porch with windows around to our side. It is now enclosed and has a picture window and sliding door with a small deck. When it was the porch with more windows, or as is now, it did seem like we, the neighbors, were invading privacy because of the closeness to the living area to the lot line, windows, doors etc. 1. When we are outside lake front we can clearly hear, many times, conversations by them with their windows closed, phone calls taking place, or could tell what TV show they were watching. 2. At dusk or nighttime it is hard to avoid thinking we are peering in on their privacy when they are inside and we are outside lake front again because of the closeness of the cabins "living area" to the lot line. (Interior lights on you can see a lot...) So we would be on the dock or closer to our cabin rather than out in the yard to avoid seeing inside so clearly. It would be a better situation for all to have this 10' setback- it would allow for a bit more privacy for both parties. We do not believe that a two story structure could be built on the existing foundation. This is a one time chance to have the appropriate setbacks required for a little more added privacy and to not seem like we are on top of one another. We are thinking that what we have written above has not been considered by the new owners. We are just stating the facts about what we observe/hear as the cabin is situated now. If it were us rebuilding we have learned the further away the living area walls are to the lot line the better for enjoyment. Thank you for considering this request.
