I understand that I have applied for a variance from the requirements of the Shoreland Management Ordinance of Otter Tail

Motion was made by Dan Oehler, seconded by Cecil Femling and unanimously carried, to approve a variance of 4'
from the required 10' setback for the placement of a septic tank 6' from an existing garage. The structure does not
have a basement and it is not used as a dwelling. After additional discussion and consideration, motion was made by
Cecil Femling, seconded by Berton Olson and unanimously carried, to grant a variance of 6’ for the storage of a
camper unit, with the proper permit from the Land and Resource office, 4’ from the drain field. The camper is not
used as a dwelling and is only stored in this location.

Block 6 and Lot 1 of Block 7, Leaf Lake Pleasure Grounds into three parcels. The property is located in Section 22
of Leaf Lake Township on West and East Leaf Lake. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by Dan Oehler, seconded by Craig Anderson and unanimously
carried, to deny the variance to subdivide Block 4, Lot 14 of Block 2, Lots 8 and 9 of Block 6 and Lot 1 of Block 7,
Leaf Lake P leasure Grounds into three parcels as no adequate hardship had been shown and the granting of the
variance would take an existing substandard situation and make it more substandard. There is a lack of area and
frontage to create three standard sized lots.

Jon Kevin Bergerson, Moorhead, MN, requested a variance of 4' from the required 10' setback for the placement of
a septic tank 6’ from an existing garage and a variance of 6' from the required drain field setback of 20' for the
storage of a camper trailer 14' from the drain field. The property is described as Lot 6, Jerry's Breezy Beach,
Rush Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request, After
consideration, motion was made by Dan Oehler, seconded by Cecil Femlingand unanimously carried, to approvea
variance of 4' from the required 1 O' setback for the placement of a septic tank 6' from an existing garage. The
structure does not have a basement and it is not used as a dwelling. After additional discussion and consideration,
motion was made by Cecil Fern ling, seconded by Berton Olson and unanimously carried, to grant a variance of 6' for

Roger Galbreath - Approved
Roger Galbreath, Fergus Falls, MN, requested a variance of 75' from the required ordinaryhigh water level
setback of 100' for the placement of an 8' by 12' structure 25' from the creek. The property is described as part
of Government Lot 4, Section 4 of Dane Prairie Township on Wall Lake. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Berton Olson, seconded by Dan Oehler
and unanimously carried, to approve a variance of 75' from the required ordinary high water level setback of
100' for the placement of an 8' by 12' structure 25' from the creek with the condition the existing 5' by 6'
structure be removed. Hardship being a substandard lot of record. This structure should be no closer to the creek
than 25',
Fred and Jeanette Kroog - Denied
Fred and Jeanette Kroog, Battle Lake, MN, requested a variance from the required side lot line setback of 10' for
the addition of siding to the north side of an existing carport located within 2' of the side lot line. The property is
described as Lot 5, and the NELY 3' of Lot 6, Block 3, Midway Park and adjacent vacated alley. Otter Tail Lake in
Otter Tail Township, The audience was polled with no one speaking for or against the request. Letters in favor of
granting this variance request from the following individuals were read for the record: Bob and Delores Buhl,
Kenneth and Mary Arens, Robert and Elsie Holtan, Gary and Marie Holtan and Carol Harshbarger. A letter from
Dale A, Bakko opposing the granting of this variance was read for the record. In addition to his letter Dale A. Bakko
submitted a video of the property that was viewed at the time of the hearing. After consideration, motion was made
by Craig Anderson, seconded by Cecil Femling to approve the addition of the siding to the north side of the existing
carport during the period of October 1st, through March 31st of each year with the siding to be removed during
the rest of the year. This motion failed with Craig Anderson, Dan Oehler, George Walter and Berton Olson voting no
and John Everts abstaining. After additional discussion and consideration, motion was made by Craig Anderson,
seconded by Dan Oehler and carried with John Everts abstaining, to deny the variance as raguested as no adequate
hardship had been shown.
Delbert A. Hoffman - Approved
Delbert A. Hoffman, Dent, MN, requested a variance of 8' from the required side lot line setback of 10' and a
variance of 99’ from the required ordinary high water level setback of 200’ for the construction of a garage 101’
from the ordinary high water level. The property is described as Lot 13, Borups Maple Beach, Dead Lake in Dead
Lake Township, The audience was polled with no one speaking for or against the request. After consideration,
motion was made by Craig Anderson, seconded by John Everts and unanimously carried to approve a variance of 8'
from the required side lot line setback of 1 O' and a variance of 99’ from the required ordinary high water level
setback of 200’ for the construction of a garage 101' from the ordinary high water level. The granting of this
variance places the new structure further back from the ordinary high water level than the existing structure
making a substandard situation less substandard and the new structure will be no closer to the side lot line than
the existing structure.
Paul I. Flogstad - Approved
Paul I, Flogstad, Sioux Falls, SD, requested a variance of 6' from the requiredside lot line setback of 10' for a 6’
by 12' addition to the rear of an existing cabin. The property is described as Lot 2, Linden Grove, Clitherall Lake
in Clitherall Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Berton Olson, seconded by Cecil Femling and carried with John Everts
abstaining, to approve a variance of 6' from the required side lot line setback of 10' for a 6’ by 12’ addition to the
rear of an existing cabin. Hardship being a substandard lot of record. The addition will be no closer to the lake
than the existing structure. The granting of this variance is consistent with the granting of a variance request in
1989,

Marilyn Ann Gilsdorf -Approved
Marilyn Ann Gilsdorf, Phoenix, AZ, requested a variance to construct new structures in essentially the same
location as the existing structures. A 12' by 20’ structure will replace an existing 1 O' by 16' structure and will
require a variance of 6' from the required side lot line setback of 10'. Two existing outhouses will be replaced
with an 8' by 6’ storage building and will require a variance of 6' from the required side lot line setback. The new
structures will be located 4' from the side lot line. The property is described as Lot 50, Barry’s Addition to
Killarney Beach, Pelican Lake in Dunn Township, The audience was polled with no one speaking for or against the
request. Letters from Mary Jo Reimer and Ellen and Jack Reihl in favor of granting this variance request were
read for the record; After consideration, motion was made by Craig Anderson, seconded by John Everts and
unanimously carried, to approve the replacement of two existing outhouses with an 8' by 6' storage building 4'
from the sicte lot line. The storage building will be no closer to the lot line than the two existing structures. The
replacement of these two structures will be an improvement and upgrading of the property. After additional
consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve
the replacement of an existing 10’ by 16’ structure with a 12’ by 20’ structure 6’ from the side lot line. The 12’
by 20’ structure can be no closer to the lot line than the existing structure. The applicant may build a different
sized structure as long as it is at least 6’ from the side lot line and meetsall other setback requirements.
Herb Christensen, Jr. - Withdrawn
Herb Christensen, Jr.. Battle Lake, MN, requested a variance to split off a parcel of less than 2.5 acres, by metes
and bounds description, from an existing 72.58 acre parcel. The new parcel will contain 100’ of lake frontage.
The property is described as Lot 1 and the NE1 /4NE1 /4. except platted. Section 31 of Otter Tail Township on Otter
Tail Lake. The audience was polled with no one speaking for or against the request. After discussion and
consideration the applicant has decided to withdraw his request and will receive a partial refund, in the amount of
$ 15,00. of his variance application fee.
