Dear Mr. Fuller:
According to the minutes that our office received regarding the December 7,
1995 hearing of the Board of Adjustment, your variance request was denied.
It appears that the Board of Adjustment felt that the 25% Impervious Surface
rule had been violated along with the setback rules.
This ruling leaves you with one option to bring your situation into
compliance and that is to remove the offending utility structure,
to avoid further legal action, this structure must be removed by June 1,
1996.

Page 2 - December 7th, 1995
Larry E. Fuller - Denied
Larry E. Fuller, Plymouth, MN, requested a variance of 6’ from the required septic tank
setback of 10' and a variance of 4' 9* from the required side lot line setback of 10' for
the location of an existing 8' by 12' shed 4' from the septic tank and 5' 3" from the side
lot line. The property is described as Lot 8, Merryland Park, Marion Lake in Rush Lake
Tovnship. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Craig Anderson, seconded by Cecil Femling and
unanimously carried, to table this variance request.until the December 1995 meeting for
additional information regarding the amount of the applicant's lot that is covered with
impervious surfaces. December 7th, 1995, Meeting - The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by Cecil Femling and unanimously carried, to deny the variance as
requested as the existing structures and other impervious surfaces already exceed more
than 25X of the total lot area. It was noted that had the variances been requested before
the actual placement of the 8' by 12' shed the Board of Adjustment would have denied the
requested variances because the existing structures and other impervious surfaces exceed
more than 25% of the total lot area.
Gary Nelson - Denied
Gary Nelson, Fargo, ND, requested a variance of 5' from the required ordinary high water
level setback of 20' and a variance of 63' from the required side lot line setback of 65'
for the location of an existing 12' by 12' deck (water - oriented accessory structure) 15'
from the ordinary high water level and 2' from the side lot line. The property is
described as Lot 2, Block 1, Sybling Hills, Lake Sybil in Dora Township. The audience was
polled with John Bigler and Dorothy Bylander speaking against the applicant's request.
After consideration, motion was made by Craig Anderson, seconded by John Everts and
unanimously carried, to deny the variance as requested as no adequate hardship had been
shown and the granting of this request would establish a precedence. The Board of
Adjustment granted the applicant until June 1st, 1996, to either remove the water -

oriented accessory structure or to place the water - oriented accessory structure in a
location that complies with the requirements of the ordinance,
variances been requested prior to the placement of the water - oriented accessory
structure in its present location the Board of Adjustment would have denied the requested
variances for the same reasons as stated above.
It was noted that had the
