(6:45 p.m.) After consideration and discussion, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and to direct that the applicants bring the deck into compliance with the ordinance on or before October 1,2005. MN • 1-800-346-4870BK — 0403 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, July 7, 2005 The Otter Tail County Board of Adjustment met Thursday, July 7, 2005, with the following persons in attendance: Cecil Femling Randall Mann Robert Schwartz Michael Conlon Paul Larson Steve Schierer Mark Ronning, Land and Resource Management David Hauser, County Attorney Heather Brandborg, Assistant County Attorney Stephanie Morris, Otter tail County Intern Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. • ■'VX Minutes Approved - The Board of Adjustment approved the minutes of the June 2, 2005 Board of Adjustment meeting as mailed. The Board of Adjustmeht considered the following applications for variance: Leland O. Raske - Approved the variance application as requested. (6:32 p.m.) Leland O. Raske, Lot 7 Walvatne Addition, Blanche Lake in Everts Township, requested a variance of 4’ from the required road right-of-way setback of 20' for the construction of a 24’ by 24’ attached garage 16’ from the road right-of-way. Randall Mann, Chair, polled the audience with no one, speaking for or against the variance as requested. After consideration and discussion, Cecil Femling made a motion, second by Robert Schwartz and carried with Randall Mann and Steve Schierer voting no, to approve a variance of 4’ frbrri the required road right-of-way setback of 20’, for the construction of a 24’ by 24’ attached garage 16’ from the road right-of-way. Hardship is a substandard lot of record. Those voting in favor of the approval noted other similar structures in this immediate area that are hot setback 20’ from the road right-of-way, therefore, the granting of the variance as requested will provide the applicant with the ability to enjoy the same rights and privileges as others in this immediate area. Those opposing the approval noted that there is adequate room to place the proposed garage 20’ from the road right-of-way and the applicant can obtain a reasonable use of his property without the granting the requested variance. John and Judy Lengyel - Denied. (6:45 p.m.) : ’ John and Judy Lengyel, Lot 4 Merryland Park, Marion Lake in Rush Lake Township, requested the following: Request variance from roofed deck setback req. specified in Section 4-H-2 of Shoreland Mgmt. Ordinance. (Deck setback must not exceed 15% of existing shoreline setback of the structure froni the OHWL). Property has cabin built in 1940’s with 40’setback. Property has lakeside deck that was constructed an unknown amount of time prior to 1996 by,previous owner. Existing 10’deck had a 30’ setback and uses 25% of the setback from OHWL. Deck repairs and roof addition were made using existing substructure and maintaining same 30’ (25%) setback as original deck. Setback from OHLW is ■ equal or greater than decks on adjacent properties. Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested.
