Motion
Motion was made by Craig Anderson, seconded by George Walter and unanimously carried, to approve a variance
that will redefine the lot line between two existing parcels and that will create two parcels of more equal size as
depicted on the registered sun/eyor’s drawing and to approve a 9’ variance, for both Tract C and Tract D, from the
required back lot line setback of 10’ for the placement of a septic tank and/or drain field 1 ’ from the back lot
line/roadway. It should be noted that the granting of this variance will allow the reshaping of two substandard lots into
two lots more equal in size, will provide each lot with water frontage that is closer to the requirements of the ordinance,
will provide greater separation between an existing dwelling and the lot line, will make each lot better suited for the
placement of a septic system and the granting of the variance is not in conflict with the intentions of the shoreland
management ordinance.

John LeRoy and Thomas Hiedeman - Approved
John LeRoy, Fergus Falls, MN, and Thomas Hiedeman, Underwood, MN, requested a variance “to put
septic system and drain field on or across lot line. Between LeRoy and Hiedeman to accommodate
new bldg, on Hiedeman and eventual new home on LeRoy. Also to put close (2’ to 4’) to back of lot as
space is limited. LeRoy’s well will be moved.” The required setback from a lot line for the placement of
a holding tank and/or a drain field is 10’. The property is described as Lots 1 and 2, Jensen’s Survey
Lots of Government Lot 5, Section 1 of Sverdrup Township by East Lost Lake. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, seconded by Robert Schwartz and unanimously carried, to approve a variance to place a
septic system and drain field on and/or across a common lot line and within 2 to 4’ of the back lot line
noting a written property owner’s agreement has been prepared and the proposed location has been
recommended by a licensed installer. Hardship is substandard lots of record.
Susan Jensen - Approved
Susan Jensen, Ottertail, MN, requested a variance to redefine the lot line between two existing parcels
and to create two parcels of more equal size. The property concerned in this variance application is
identified as Tract C and Tract D on the applicant’s registered surveyor’s drawing. Fred Fudpucker
owns a portion of this property with the balance of the property owned by Susan Jensen. The property
is described as part of Government Lot 6, Section 34 of Rush Lake Township by Mud Lake. Clem
Hendrickson, Surveyor, appeared along with the applicant at the public hearing. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by George Walter and unanimously carried, to approve a variance that will
redefine the lot line between two existing parcels and that will create two parcels of more equal size as
depicted on the registered surveyor’s drawing and to approve a 9’ variance, for both Tract C and Tract
D, from the required back lot line setback of 10’ for the placement of a septic tank and/or drain field T
from the back lot line/roadway? It should be noted that the granting of this variance will allow the

of 10’ for the construction of a 24’ by 24’ garage 4’ from the lot line. The property is described as Lot
10, Jerry’s Breezy Beach, Rush Lake in Rush Lake Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by George Walter,
seconded by John Everts and unanimously carried, to approve a variance of 6’ from the required side
lot line setback of 10’ for the construction of a 24’ by 24’ garage 4’ from the lot line. It should be noted
t|iat the proposed garage would be no closer to the side lot line than the existing 12’ by 20’ carport.
