Explain your problem here: Parcels A & B have been, for some years, owned together as
one tract and are now owned, in fee, by Hilsman. Hilsman has sold parcels
A & B to Nelsen on a Contract for Deed. Nelsen would now like to sell parcel
A to another individual on a Contract for Deed which has already been pre
pared and signed but which we have been unable to record.
Henry Smith owns parcel C. He has a garage on his property that is barely
inches away from the east line of parcel B as shown on the map. For this
reason he would like to buy parcel B, a deed for which has already been given
but has not been recorded.
Rose Rach owns parcels D, E & F as shown on the attached drawing. She bought
her property in two separate parcels and her property extends all the way from
the west line of parcel A to the road. She has a year-round home on her
property.
There is a cabin on parcel A with a front porch. The front porch of this
cabin extends 7 feet over on Rose Rach's property to the west. Mrs. Rach is
willing to help correct the encroachment problem and has given a quit claim
deed for a 10 foot wide strip on the east end of her property (this 10 foot
strip being shown on the attached drawing as parcel D). This quit claim deed**

We are seeking a variance in order to record the three documents;
The contract for deed from Nelsen to his buyer for parcel A, the
deed for parcel B to Henry Smith, and the deed from Rose Rach for
parcel D. If parcels E & F are combined in Courthouse records
(as the auditor's office indicated they would be), the net result
of all of these transactions will be to convert what is now four
lots into three;
E & F combined will be one lot
D & A combined will be a second lot
B & C combined will be the third lot.

Whiter to rescind the motion on the matter that was made at the April
3rd meeting. The motion was seconded by John Everts and carried upon

mission to construct family room onto existing cabin, 57' fron lake
on Lot 2, Pelican Beach, Scambler Township. After consideration,
motion was made by John Everts to approve a variance using the "string
test" allowing building no closer to the lake than the neighbors on
either side. The motion was seconded by Victor Petterson and carried
upon the following vote:

Previous application for variance to re-align lot lines was granted
"provided Parcel #A would be no less than 84' in width."
Efforts to comply have failed.' There is not enough space between west line
of "D" and structure (year-round home) on "E" to acguire the additional
14 feet needed to keep Parcel "A" at 84 feet. Nor is there enough space
between east line of "A" and garage on "B" to acquire the additional feet.
