The hardship is Permit No. 478, issued June 19, 1972, which permitted the placement of the existing 24’ by 30’ structure 6’ from the common lot line of Lots 18 and 19. John C. and Peggy Carlson - Denied road right-of-way variance. Approved a variance from the marina. Approved a variance for the placement of a fence. John C. and Peggy Carlson, Wahpeton, ND, requested a variance of 3’ from the required road right-of-way setback of 20’ and a variance of 28’ from the required ordinary high water level setback of 75’ for the construction of a 30’ by 30’ garage 17’ from the road right-of-way and 47’ from the marina (ordinary high water level). Also, requesting a variance of 29’ from the required ordinary high water level setback of 75’ for the placement of a 48’ long by 6’ high fence 46’ from the ordinary high water level. The property is described as Lot 1, Block 1, Blarney Beach, Otter Tail Lake in Everts Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to deny the variance from the road right-of-way as requested as no adequate hardship unique to the property had been shown, to approve an ordinary high water level variance from the marina which would allow for the placement of the proposed structure 20’ from the road right-of-way, but within the required ordinary high water level setback area and to approve the placement of a fence no closer to the ordinary high water level than the shed on the neighbor’s property as depicted on the applicants’ drawing. The granting of the variance as approved will provide the applicants with a reasonable use of there property. Hardship is a substandard lot of record and the terrain features of the applicants’ property. Thomas C. and Irene W. Allmaras - Approved as modified with a condition. Thomas C. and Irene W. Allmaras, Battle Lake, MN, requested a variance to subdivide, by metes and bounds description, a parcel approximately 60’ by 250’ from an existing parcel of less than 5 acres for the purpose of conveyance to an adjacent property owner. The property is described as part of Government Lot 3, Section 2 of Everts Township by Otter Tail Lake. Robert Yaggie represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by Linda Bergerud and unanimously carried, to approve the conveyance of the following described parcel with the condition that it must be permanently attached to the Robert and Darlene Yaggie property: The North 220 feet of the South 435 feet of the West 59.5 feet of the East 1,034 feet of Government Lot 3, Section 2, Township 133 North, Range 40 West of the 5‘^ Principal Meridian, Otter Tail County, Minnesota. It was also stated that the property being retained by Thomas C. and Irene W. Allmaras would continue to be classified as a substandard lot of record for future development purposes. The proposed subdivision will not cause the classification of the portion being retained by the Allmaras to change. Hardship is the terrain of the applicants’ property. It was also noted that the variance as approved will provide Thomas C and Irene W. Allmaras with access to a dedicated public road. David Adams - Approved as requested. David Adams, Richville, MN, requested a variance of 17’ from the required road right-of-way setback of 40’ for the placement of a 40’ by 120’ building 23’ from the road right-of-way. The property is described as the Northwest Quarter of the Southwest Quarter and the Southwest Quarter of the Northwest Quarter, Section 18 of Rush Lake Township. A letter from Andrew Klinnert, Chairman Rush Lake Township was noted for the record. The audience was polled with no one speaking for or against the request. December 13, 2001 ■ ;'^ge#3 David Adams - Approved as requested (Continued). After discussion and consideration, motion was made by Cecil Femling, second by David Holmgren and unanimously carried, to approve a variance of 17’ from the required road right-of-way setback of 40’ for the placement of a 40’ by 120’ building 23’ from the road right-of-way noting that the applicant had contacted Rush Lake Township and that the township was not opposed to the present location of the structure. It was noted that the present location of the structure does not obstruct the view of the road or the view from the road. It was also noted that the present location of the building would not interfere with road maintenance or with snow removal. Allen and Margaret Mashek - Approved as modified with conditions. Allen and Margaret Mashek, Elbow Lake, MN, requested a variance of 20’ from the required road right-of- way setback of 20’ for the replacement of a dwelling 0’ from the road right-of-way, a variance to move an existing garage 6’ east, and a variance of 20’ from the required road right-of-way setback of 20’ for an addition to the existing garage 0’ from the road right-of-way. It should be noted that the proposed new dwelling would extend over the existing east lot line. The adjoining west Vz of Lot 3 has been surveyed and will be permanently attached to Lot 4. This will allow the new dwelling to meet the 10’ side lot line setback. The existing cabin on the west 14 of Lot 3 will be removed. The property is described as the West Half of Lot 3 and all of Lot 4, Block 1, Marheine’s Camp Corliss First Addition, Clitherall Lake in Clitherall Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling to approve the variance as requested noting that it was a substantial improvement over the prior request and noting that their was no new development within the road right-of-way. Hardship is the terrain of the applicants’ property and a substandard lot of record. Before this motion was acted upon the applicant presented a letter from Arlyn Hustad, Clitherall Township Clerk, noting that the Town Board does not oppose the proposed development as long as all buildings are outside of the township road right-of-way. As a result of this letter the above referenced motion was withdrawn. After additional discussion and consideration, motion was made by Steve Schierer, second by David Holmgren and unanimously carried, to approve a variance of 20’ from the required road-right-of-way setback of 20’ for the placement of a dwelling and a garage 0’ from the road- right-of-way with the following conditions; 1. that before a permit for the new construction can be issued the existing dwelling on Lot 4 and the existing dwelling on the west 1/3 of Lot 3 must be removed and 2. all buildings must be out of the road right-of-way after completion of the proposed development. Hardship is a substandard lot of record and the terrain features of the applicants’ property. It was noted that the variance as approved does provide the applicants with a reasonable use of their property, removes all buildings from the road right-of-way and is generally an overall improvement to the area. Alan W. Pettit Trust-Tabled Alan W. Pettit Trust, Wadena, MN, requested the following; ‘We will have to re-roof the roof in the future. So we want to raise the back or south side of roof in a dormer fashion so that we will have more headroom on that side or south side of roof. The north side of roof is higher than the back or south side. The building will not be made wider, longer etc. Just part of same maybe 3 to 5 ft higher to match front. Carpenter calls it changing roof style.” It appears that the variance necessary is a variance to raise a roof on a second dwelling (sleeping room). The property is described as part of Jackson and McKees Addition and part of Government Lot 1, Section 23 of Pine Lake Township by Big Pine Lake. An email from Sylvester and Louise Knapp in support of the variance as requested was read for the record. The audience was polled with no one speaking for or against the request. Add depth of clean sand for separation (2a) at upslope edge, depth of rock layer (1 foot) to depth of cover (1 foot) to find the mound height at the upslope edge of rock layer: / ft + 1ft + 1ft = 3 feet c. Multiply upslope mound height by^ to find berm width: 3 x5 = _2_ feet d. The total landscape width is the sum of berm (G.2c) width plus rock layer width (D.2) plus berm width(G.2c): ^ ft+ / O ft+^___ft= S’ feet e. Subtract the landscape width (G.2d) from the adbsorption width (F.4) to find the additional width necessary for absorption: ft - ft = feet (If less than zero, no additional width is needed. Therefore, skip step f and go to g.) f. Add the additional width (G.2e) to the berm width (G.2c) Final berm width:ft + g. Total mound width is the sum of berm (G.2f (use G.2d if step f was skipped)) width plus rock layer width (D.2) plus berm width(G.2f or G.2d): ^ ft + / ^ ft + *7 ft = feet h. Total mound length is the sum of berm (G2.f or G.2d) plus rock layer length (D.3) plus berm (G.2f or G.2d): 9 ft +37q- ft + 9 ft = feet i. Setbacks from the rockbed are calculated as follows: the absorption width (F.4) minus the rock bed width (D.2) divided by 2: (/•S'r 2-ft - ^ ^ ft) + 2 = feet Cover 1'Landslope;___% slope rado 4:1 ■ I^Rockr .f!
