It is the intent of this letter to clarify this confusion. This office wrote a letter dated Aug. ITTTt expressing concerns about this application. That letter and opinions expressed still represent our position. At least two individuals personally in volved in this matter have approached me concerning adding fill to the site. To clarify the recordi I HAVE NOT proposed any filling activity as an acceptable solution. Ue discussed the idea grantedi but my response was not and is not favorable to such filling. High groundwater table conditions! high lake level conditions and ques tionable soil stability indicate to me the potential for problems with sewage disposal and dwelling site stability. Much of the in tent of the county shoreland management ordinance and the state shoreland management regulations is to restrict development of un suitable sites! such as this. State Regulations Cons 73 {b>{S>-Caa> state: No structure! except boathouses! piers and docks! shall be placed at an elevation such that the lowest floor! including a basement! is less than 3.Q feet above the highest known water level. Thusi the site in question is only ft- or 1.2 inches above the highest known water level. Furthermore! Cons 74 {a} states as follows: No land shall be subdivided which is held unsuitable by the county for the proposed use because of flooding! in adequate drainage! soil and rock formations with severe limitations for development . . . unfavorable topography! inadequate . . . sewage disposal capabilities or any other feature likely to be harmful to the health safety and wel fare of the future residents of the proposed subdivision . • Because of frequent high water conditions on Rush Lake! the elevation of the proposed site and the nature of the low swampy ground behind this site! the site suitability for development leaves a great deal to be desired. Thus! this office re-affirms the previous Aug. l! letter and hopes you take it and this letter into consideration before approv ing Lather's application. Thus the lake was 1-4E feet above the ordinary high water- life then went to the site of Ole Lather's application- The highest piece of ground we could find on this site was O-b feet above pre sent lake level or equivalent to 7-fl ft- on th¥~heatfwater gage- Thusi there is only E ft- of elevationn at maximumi above the or dinary high water on this site- Knowing the great range in water level fluctuations on this lakei it is the conclusion of this office that any lakeshore development on this site would be subject to periodic flooding problems- Add- itionallyi I question the stability of the soil here to support any dwellings- The soil was spongy to walk upon during the investiga tion- Even with fillingn it is my opinion that proper adequate sewage disposal would be most difficult to accomplish and maintain- I would hope you would take these concerns into consideration when deciding the issue at hand- If the road is intended to serve platted lotsn as stated in the application! development on those platted lots could represent a potential site construction and sewage disposal problem- AN EQUAL OPPORTUNITY EMPLOYER Page E Aug.
