July 5, 2012 meeting - The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Steve Schierer, with the verbal and written agreennent of the applicants made a motion, seconded
by Thomas Lee and unanimously carried, to table the applicants’ request until the next scheduled meeting of the Board of
Adjustment, which will provide the applicants with an opportunity to meet with a representative of the Land and Resource
Department and an opportunity to determine if the proposed development can meet the 3’ vertical separation requirement.
August 2, 2012 meeting - After consideration and discussion, Randall Mann made a motion, seconded by Steve Schierer and
unanimously carried, to approve the proposed development as outlined in the variance application dated June 12, 2012 with the
condition that the required 3’ vertical separation (between water level and lowest floor) must be maintained. The variance as
approved will provide the applicants with the ability to enjoy the same rights and privileges as others in this immediate area.

Michael Ruther, part of the Northeast Quarter, the east half of the Northwest Quarter and the Northwest Quarter of the
Southeast Quarter, Section 33 of Corliss Township, requested a variance of 10’ from the required road right-of-way
setback of 40’ for the placement of 48’ by 70’ shed 30’ from the road right-of-way. The audience was polled with no
one speaking for or against the variance as requested. A letter from Charles H. Grotte, Assistant County Engineer
stating that the highway department had reviewed the request and determined that the location of the proposed shed
will not negatively impact visibility or the highway department’s ability to reconstruct CSAH 8 was read for the record.
After consideration and discussion, Paul Larson made a motion, seconded by Michael Harris and unanimously
carried, to approve a variance of 10’ from the required road right-of-way setback of 40' for the placement of 48’ by 70’
shed 30' from the road right-of-way. The new structure will be no closer to the ordinary high water level than the
existing structure.

the variance as requested. After consideration and discussion, Paul Larson made a motion, seconded by Thomas
Lee and unanimously carried, to approve a variance of 30' from the required ordinary high water level setback of 100’
for the placement of the proposed dwelling, as depicted on the drawing dated July 11, 2012, 70’ from the ordinary
high water level. The proposed development will not obstruct the view from the adjacent properties. The variance as
approved will provide the applicants with the ability to enjoy the same rights and privileges as other in this immediate
area. The variance as approved does not directly or indirectly grant any other variances for the proposed
development.
Jospeh Dean - Approved the application as requested. (7:35 p.m.)
Joseph Dean, Lot 13 Madison Beach, Clitherall Lake in Clitherall Township, requested the following: I am requesting
a variance from the 100’ structure setback. I would like to construct a 10’ by 18’ screen porch on top of an existing
deck that is 10’ by 46’ long on the front of my residence. The existing deck is 78’ from the high water mark. The
audience was polled with no one speaking for or against the variance as requested. An email from Ronald A. Molitor
in opposition to the variance as requested was read for the record. After consideration and discussion, Steve
Schierer made a motion, seconded by Randall Mann and unanimously carried, to approve a variance of 22’ from the
required ordinary high water level setback of 100’ for the construction of a 10’ by 18’ screen porch on top of an
existing deck located 78’ from the ordinary high water level. The proposed development will not change the overall
impervious surface coverage, will not obstruct the view from the adjacent properties, will not encroach on the bluff
area, and is not within the shore impact zone. The hardship/practical difficulty is the terrain features of the applicant’s
property.
David and Gaylen Pirri - Approved/Denied. (7:42 p.m.)
David and Gaylen Pirri, Lot 5 Block 1 Oak Grove Summer Resort, Pelican Lake in Scambler Township, requested the
following: non-dwelling reduced setback due to lot line change. 8’ from property line and 6’ from drain field.
As depicted on my drawing, the proposed garage would replace the existing one and would be the same distance
(approximately 8 feet) from the new property line. The other side would be approximately 6’ from the end of the drain
field, (per phone conversation 7-11-2012 with David Pirri information copied from letter submitted along with
application). Bruce Danielson, Contractor represented the applicants at the public hearing. The audience was polled
with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer
made a motion, seconded by Michael Harris and unanimously carried, to approve a 2’ variance from the required side
lot line setback of 10’ for the placement of the proposed structure 8’ from the side lot line and at least 10’ from the
drain field. It was noted that the proposed development will be no closer to the lot line than the existing structure.
The variance as approved does not directly or indirectly grant any other variances for the proposed development.

requested a variance of 102’ and a variance of 119’ from the required ordinary high water level setback of 200’ for the
placement of cabin and deck 98’ from the ordinary high water level and for the location of a future garage site 8T from
the ordinary high water level. Dean Kapphahn, Contractor, appears with the applicants at the public hearing. The
audience was polled with Paul Halvorson speaking for the variance as requested. After consideration and discussion,
Steve Schierer made a motion, seconded by Paul Larson and unanimously carried, to approve a variance of 100’ from

following: Proposed dwelling unit would be within 50’ of lot line setback which is an adjacent cluster development
driveway. With approval of proposed dwelling, 5 existing structures will be removed within 2 years after completion to
enhance lot appearance. Request to be 25’ to lot line. The applicant will file for a conditional use permit upon
approval of the variance application. The audience was polled with Barb Olson seeking clarification as to the location
of the proposed structure. After consideration and discussion, Rod Boyer made a motion, seconded by Paul Larson
and unanimously carried, to approve a variance of 20’ from the required side lot line setback of 50’ for the placement
of the proposed dwelling 30’ from the side lot line with the condition that no more than 25% of the total eligible lot area
can be covered with impervious surfaces. The variance as approved will not negatively impact this immediate area.
Greg and Jenny Maue - General Discussion (7:20 p.m.)
Greg and Jenny Maue submitted a letter dated June 19, 2012 describing the planned improvements to
their property and noting the differences from the variance as previously approved in 2003. After general
discussion and consideration, the Board noted that the proposed improvements as described are within the
spirit and intent of the variance as originally approved. The proposed improvements appear to be less
substantial than those previously approved by the Board of Adjustment in 2003. The Board took no formal
action as it would not be appropriate to act outside of the receipt of a formal application and the Board has
no authority to change the variance that was granted in 2003.
