Dear Bill,
Please see the below listed responses to your additional questions:
1. Top Soil Replacement: Our Excavating bid includes having the Contractor spread
the topsoil back over the area after the fill has been placed. The topsoil should be
spread the same day as the excavating is completed, or possibly the next day. I’ve
enclosed a copy of the bid from the contractor we plan to use.
2. Grass Seed Type: I’m planning to use a grass seed mix called Northland grass
seed, which has been designed for Northern climates. It contains approximately
27% Kentucky Bluegrass, 25% Cornucopia Perennial Ryegrass, 20% Red Fescue,
15% Clearwater Kentucky Bluegrass, and 10% Annual Ryegrass. If there is
another seed mix that you think would be better, please let me know.
3. Seeding Date: My reasoning in stating that the grass would be planted within 7
days was to give myself enough time to pick out all of the sumac roots from the
area and prepare it for seeding. Additionally, I want to spread some composted
manure on the area before I plant. If the excavation work is done on a Monday
for example, I may not be able to get all of the preparation work done until the
following weekend.

Dear Matt Sauer:
On June 16, 2004 the Planning Commission passed a motion to recommend approval of
your request. Their motion is as follows:
A motion by Lachowitzer, second by Estes to approve with the following conditions: 1.
There is no earthmoving within 30’ of the top of the bluff. 2. An erosion control plan is
provided to the Land & Resource Management Office and approved by them. Reasons
for approval being that this is the last lot on this side of Co. Hwy 49 left to be developed
and that this is a good use of the land.
On June 22, 2004 the County Board of Commissioners passed a motion to approve the
request as recommended by the Planning Commission.
On June 18, 2004, our Office received your erosion control plan (plan). Bill Kalar has
reviewed this and would like some additional information.
1. He would like you to state the time period between removing the topsoil and putting
it back
2. He would like you to specify the type of grass seed you propose to use .
3. He questions the reason you intend to wait 7 days after the disturbance to plant the
grass seed.
Once the erosion control plan is approved, the Conditional Use Permit will be processed.

To Whom It May Concern:
After discussions with excavating contractors and others, our plan for erosion control is
as follows:
To have the topsoil scraped into a pile, then complete the excavation work, and then
spread the topsoil back over the disturbed area. The topsoil includes quack root, which
will spread, and we will also seed the entire area with a fast emerging grass seed within 7
days of completion of the project. As this area will be our lawn once our home is built,
we want to get the grass growing as soon as we can.
If you require any additional information, please let me know.

Meeting of the Otter Tail County Planning Commission was held on June 16, 2004 at 6:30
P.M. in the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Rod Boyer, Les Estes, Frank Lachowitzer, Joe Maske, Bert Olson,
Robert Schwartz, Richard Sha, Rick Wilson and Leona Zimmerman.
Members Absent: David Trites.
Barb Hanson represented the County Attorney's Office and Bill Kalar represented the Land
& Resource Management Office.
Minutes of June 9, 2004: The June 9, 2004 Minutes will be acted on at the next Meeting.
Matt & Heidi Sauer - Approved With Conditions:
A Conditional Use Permit Application as stated by the Applicant. Grading and filling of
earth to create building site for single family home to be built at a future time. Approx.
1500 yards of dirt to be moved. The property is described as Pt GL 1 com NE cor of GL 1
S 436’ ...(5.20 AC), Section 8, Rush Lake Township Marion Lake (56-243), GD.

conditions: 1. There is no earthmoving within 30’ of the top of the bluff. 2. An erosion
control plan is provided to the Land & Resource Management Office and approved by

be developed and that this is a good use of the land. Voting: All Members in favor.
“Waters Edge” / PAC Investment Inc. - Tabled to July 21, 2004:
A Preliminary Plat titled "Waters Edge” consisting of 4 Residential Lake Lots and 9
Residential Back Lots, 2 BIks for Single Family Residential Use. A Conditional Use Permit
Application as stated by the Applicant To construct approx. 2,100 feet of road for the
proposed development of Waters Edge. The proposed dedicated road will be constructed
to the minimum road standards of Appendix 3 of the Otter Tail County Subdivision
Ordinance. The property is described as Sublot A & B of Government Lot 6, Section 21 of
St. Olaf Township: Sewell Lake (56-408), RD.
Motion- September 17, 2003: A motion by Trites, second by Estes to table (at the
Applicant’s request) to May 12, 2004 to provide time for the Applicant to reconsider the
number of lots and their configuration. Land & Resource Management must receive the
revised plan by April 23, 2004. Reasons to table include the potential flooding of the area
and drainage issues.

11:00 a.m. at the Otter Tail County Government Services Center with Commissioners

Motion by Froemming, second by Block, and unanimously carried to approve the County

Planning Commission Recommendations

Motion by Nelson, second by Mosher, and unanimously carried to approve a Conditional Use
Permit for a grade and fill project for a building site with conditions as recommended by the
Planning Commission. The property is described as Pt GL 1 com NE cor of GL 1 S
436’...(5.20 AC) in Section 8, Rush Lake Township, Marion Lake (56-243).
Preliminary Plat & Conditional Use Permit - “Krauss Woods”/Allan E. Mueller:
Motion by Nelson, second by Froemming, and unanimously carried to approve the
Preliminary Plat known as “Krauss Woods” consisting of 2 lots for single family residential
use and a Conditional Use Permit to move a portion of a road and construct a cul-de-sac to
service the plat as presented on the revised map dated June 1, 2004. The property is
described as E 470’ of Lot F of Gov Lot 2 ex tr (8.13 AC) & Pt SE% NW% in Section 21 of
Pine Lake Township, Big Pine Lake (56-130).
