The Board of Commissioners meeting was reconvened at 11:06 a.m. Planning Commission Recommendations Conditional Use Permit - Jody Shaw: Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use Permit to replace retaining walls and steps with conditions as recommended by the Planning Commission. The proposal is located in SE cor GL1 with 300’ on lake, Section 8 of Star Lake Township (1.25 ac); Star Lake (56-385), GD. Conditional Use Permit - Allan F. Jahnke: Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use Permit to replace a failing retaining wall and steps and build a patio with conditions as recommended by the Planning Commission. Scott & Susan Saver - Approved With Conditions: A Conditional Use Permit Application (as stated by the Applicant on the Application): This is an After-The-Fact Request. Violation #1 - Grading and Filling in Shore Impact Zone (SIZ). We removed the boathouse (built in 1978) due to the rising water line. The contractor removed all concrete and then replaced the shoreline with riprap. We did not extend our shoreline any wider. The 70’ of shoreline is now 52’ of riprap, 14’ of existing beach front (and sand was extended up on shore 12’) and the remaining 4’ is the existing grass shoreline. We did extend the rock 59’ to accommodate a boat access. Therefore, our request is for the removal of the boathouse and put 52’ of riprap, 59’ long of %” rock for access and have 14’ of beachfront. Violation #2-2 structures in the SIZ. The fish house was built by a local lumber yard to the guidelines of the State Code. It is on skids and is not a permanent structure. A 3 year fish house license was bought in Battle Lake but winter has blown it away. It is good until August, 2015. Drawing is enclosed (available for viewing at Land & Resource Mgt. Office) The firepit was built by Hebron Brick and I was under the assumption “all papers have been filed” as written in the quote. Measurements are enclosed (available for viewing at Land & Resource Mgt. Office). Therefore, I am requesting a fish house to be placed and a firepit to be built in SIZ. The proposal is located in the W 200’ of E 1520’ of SI/2 NE1/4, Section 9 of Eagle Lake Township: Middle Lake (56-252), NE. Susan and Scott Sayer represented the Application. Motion: A motion by Trites, second by Schwartz to grant removal of the boathouse provided: 1. The rip rap is extended 14’ westerly across the sand beach area. 2. The sand area between the fire pit and the lake (rip rap) be returned to a vegetated state. 3. The fish house is relocated to meet the required setbacks. 4. Project to be completed by October 1, 2014. Voting: All Members in favor.
