Motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the subdivision
of a tract approximately 52’ by approximately 207’ from an existing 1.08 acre parcel for permanent attachment to Lot
1, Block 1 of Rainbow Point. The metes and bounds parcel remaining, after the proposed subdivision, exceeds the
required lot width and lot area for platted lots on a general development lake.

MINUTES OF THE MEETING
OF THE
OTTER TAIL COUNTY BOARD OF ADJUSTMENT
July 3,1997
The Otter Tail County Board of Adjustment met Thursday, July 3, 1997, with the following
persons in attendance:

Call to Order - The meeting was called to order at 7:00 p.m. by Chairman George Walter.
Minutes Approved -
Hearing no corrections or additions the minutes of the June 12, 1997 meeting were approved as
mailed.
The following variance requests were heard:
Michael W. Hermanson - Denied
Michael W. Hermanson, Perham, MN, requested a variance of approximately 12’ from the
required Top of Bluff setback of 30’ for the enclosure of an existing deck approximately 18’ from
the top of the bluff. The property is described as Lot 1, Cousins Park, Big Pine Lake in Pine
Lake Township. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and
unanimously carried, to deny the variance as requested as the existing deck is located in a
sensitive area and a variance from the ordinary high water level setback is required as the
propo^d enclosure would be ahead of the building line.
bert Lenzin - Approved
Wilbert Lenzin, Chaska, MN requested a variance to subdivide a tract approximately 52’ by
approximately 207’ from an existing 1.08 acre parcel for permanent attachment to Lot 1, Block 1
of Rainbow Point. The property is described as part of Government Lots 2 and 3, Section 7 of
Rush Lake Township by Marion Lake. Clem Hendrickson, Surveyor, represented the applicant
at the public hearing. After consideration, motion was made by Craig Anderson, seconded by
Cecil Femling and unanimously carried, to approve the subdivision of a tract approximately 52’
by approximately 207’ from an existing 1.08 acre parcel for permanent attachment to Lot 1,
Block 1 of Rainbow Point. The metes and bounds parcel remaining, after the proposed
subdivision, exceeds the required lot width and lot area for platted lots on a general
development lake.

Eugene Reinholt, ET AL. - Approved
Eugene Reinholt, ET AL, Sioux Falls, SD, requested a variance of approximately 98’ from the
required ordinary high water level setback of 150’ and a variance of approximately 23’ from the
required shore impact zone setback of 75’ for the construction of a dwelling approximately 52’
from the ordinary high water level. The property is described as Lot 10, Riverview Beach, Otter
Tail River in Rush Lake Township. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Craig Anderson, seconded by
John Everts and unanimously carried, to approve construction of a dwelling up to the string line
as determined when the string line is applied between the structures on Lots 9 and 12. The
granting of this variance will place the dwelling approximately 52’ from the ordinary high water
level. The granting of this variance request is consistent with a variance previously granted on
May 5, 1994 to Lot 11, Riverview Beach. Hardship is a substandard lot of record.
Scott F. Peterson - Approved
Scott F. Peterson, Eagan, MN, requested a variance of approximately 130 to 150’ from the
required ordinary high water level setback of 200’ and a variance of approximately 30 to 50’
from the required shore impact zone setback of 100’ for the attachment and placement of a 40’
by 26’ garage/storage shed to an existing structure and for the attachment and placement of a
14’ or 16’ by 70’ mobile home approximately 50’ from the ordinary high water level at the south
side of the proposed garage/storage shed and approximately 70’ from the ordinary high water
level at the north side of the proposed mobile home. The applicant requests any variances
necessary for the placement of an upgraded septic system. The applicant’s overall
improvement plan calls for the removal of a 14’ by 22’ boat house, an 8’ by 18’ camper trailer
and a 7’ by 34’ school bus, the addition of a 40’ by 26’ garage/storage shed and a 14’ or 16’ by
70’ mobile home, the upgrading of the septic system and improvements to the road accessing
the property. The property is described as Sub Lot 6 of Government Lot 3, Section 8 of Tumuli
Township by Mineral Lake. Dennis Delzer, Contractor, appeared along with the applicant at the
public hearing. A letter from Bob and Mylla Nogowski in favor of the applicant’s request was
read for the record. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Craig Anderson, seconded by John Everts and carried
with Randall Mann voting no, to approve a variance of approximately 130 to 150’ from the
required ordinary high water level setback of 200’ and a variance of approximately 30 to 50’
from the required shore impact zone setback of 100’ for the attachment and placement of a 40’
by 26’ garage/storage shed to an existing structure and for the attachment and placement of a
14’ or 16’ by 70’ mobile home approximately 50’ from the ordinary high water level at the south
side of the proposed garage/storage shed and approximately 70’ from the ordinary high water
level at the north side the proposed mobile home, as depicted on the applicant’s drawing, with
the provision that before any part of the applicant’s project is started the applicant and the
contractor must meet with the Land and Resource office for approval of the contouring of the
area proposed for development, for approval of any earth moving plans and for approval of the
disposal of the earth that might remain as a result of the proposed development and with the
condition that the 14’ by 22’ boathouse, the 8’ by 18’ camper and the 7’ by 34’ school bus must
be removed from the applicant’s property upon completion of the proposed project. No specific
variances were granted for the installation of an upgraded septic system, but the Board of
Adjustment concurred with the installation and placement of the septic system as described by
Dennis Delzer, Contractor. It was noted that the proposed additions will be no closer to the
ordinary high water level than the existing structure and the applicant’s proposed development
will be an overall improvement in the current conditions of the lot. Hardship is a substandard lot
of record and the unique shape of the applicant’s property
