Milander RR 1 Box 19F Richville, Minnesota 56576 Dear Mr. Milander: We have reviewed information about your project to excavate a wildlife pond in an unnamed wetland provided the excavated material is placed on uplands. The project site is in Sec. 7, T. 135N., R. 32W., Otter Tail County, Minnesota. The work proposed at the location stated is not within the regulatory jurisdiction of the Corps of Engineers. No work will be done in a navigable water of the United States, and no dredged or fill material will be discharged in any water of the United States, including wetlands. Therefore, a Department of the Army permit is not reguired to do this work. This letter is valid only for the project referenced above. If any change in design, location, or purpose is contemplated, contact this office to avoid doing work that may be in violation of Federal law. Milander-Approved With Conditions: A Conditional Use Permit Application to have present pond, which is 16” deep at center now, to have pond dug 3’ deeper, and use the dug out bottom of pond to be used as fill around water edge to eliminate the wet mud on sides and edges so I can mow the grass to near waters edge. This would look nice and cut down on the mosquitoes breeding ground. Will estimate the yardage to be between 400 - 500 cubic yardage with tapered edges.
