Jim and Sue Towner - Approved the requested variance as modified and with a condition. (6:32 p.m.)
After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried,
to approve a variance of 35’ from the required ordinary high water level setback of 75’ for the placement of 24’ by 24’
garage 40’ from the ordinary high water level and adjacent to the easement with the condition that the existing 8’ by
14’ shed must be either removed or placed in a complying location. The variance as approved will located the
proposed 24’ by 24’ garage outside of the shore impact zone and will provide the property owners with a reasonable
use of their property. The Board noted that they are allowing the proposed garage to be placed adjacent to easement
since it has been determined that the easement is not a legal easement. It was also noted that the variance as
approved does not directly or indirectly grant any other variances.

MINUTES OF THE MEETING
OF THE
OTTER TAIL COUNTY BOARD OF ADJUSTMENT
Thursday, April 6, 2006
The Otter Tail County Board of Adjustment met Thursday, April 6, 2006, with the following persons in
attendance:

Michael Harris

Chair and Vice Chair Selection -
Randall Mann, Chair, opened the meeting by calling for nominations for Chair and Vice Chair of the
2006 Board of Adjustment. Cecil Femling and Paul Larson nominated Randall Mann for Chair and
Steve Schierer for Vice Chair. Randall Mann, Chair, called two additional times for other nominations.
Hearing no other nominations, Cecil Femling made a motion, second by Steve Schierer and carried, to
direct the Secretary of the Board of Adjustment to cast a unanimous ballot for Randall Mann as Chair
and for Steve Schierer as Vice Chair of the 2006 Board of Adjustment.
Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved -
The Board of Adjustment approved the minutes of the November 30, 2005 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Jim and Sue Towner - Approved the requested variance as modified and with a condition. (6:32
p.m.)
Jim and Sue Towner, Parcels 4 and 5 of Government Lot 3, Section 7 of Rush Lake Township by
Marion Lake, requested variances from the road easement and from the ordinary high water level for
the purpose of constructing a 24’ by 24’ garage. From the drawing submitted with the application the
garage appears to be 30’ from the ordinary high water level and 10’ from the south easement road at
the closest point and less than 1’ from the west easement road. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Steve Schierer
made a motion, second by Paul Larson and unanimously carried, to approve a variance of 35’ from the
required ordinary high water level setback of 75’ for the placement of 24’ by 24’ garage 40’ from the
ordinary high water level and adjacent to the easement with the condition that the existing 8’ by 14’

We are hereby resubmitting our request for a variance to build a 24’ by 24’ detached (or
attached) garage on the above property. We submitted our request last January but were
informed that we needed to resubmit for the following reasons:
Resolve violation #2177 - Resolved
Request Specific Variance requested - Road Setback, Lake Setback
Provide Impervious Calculations - 25% = 3250 Sq Ft
Current = 2568 Sq Ft
With new Garage = 3032 Sq Ft (minus the existing shed)
These calculations are computed with the 2 parcels combined. We have combined the 2
lots into one parcel and lot 5 had no structures on it.
