Motion
Motion was made by Randall Mann, seconded by John Everts and unanimously carried, to approve a variance
of 30’ from the required ordinary high water level setback of 100’ for a 24’ by 28’ addition to an existing
dwelling 70’ from the ordinary high water level with the condition that an existing 8’ by 10’ utility shed must be
placed in a legal location by August 1, 1998. It was noted that the proposed addition will be no closer to the
ordinary high water level than the existing dwelling.

Dan and Joyce Petersen - Approved
Dan and Joyce Petersen, Henning, MN, requested a variance of 10’ from the required 20’ dwelling
setback and a variance of 9’ from the required lot line setback of 10’ for the placement of a drain field
10’ from the dwelling and 1’ from the lot line. The property is described as part of Government Lot 1,
Section 21 of Leaf Lake Township by West Leaf Lake. July 9,1998 meeting -The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Randall
Mann, seconded by John Everts and unanimously carried, to table the applicants’ request until the
August 6, 1998 Board of Adjustment meeting for the purpose of providing the applicants with an
opportunity to review and discuss their plans with the Minnesota Department of Health. August 6,
1998 meeting - A letter from the Minnesota Department of Health indicating that they had no authority
in this matter was read for the record. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by Randall Mann, seconded by David Holmgren and
carried with John Everts voting no, to approve the variance as requested based upon a determination
by the Land and Resource Department that this is the best location on the applicants’ property for the
location of a system and for the protection of the quality of the lake.
Richard Kellogg - Tabled
Richard Kellogg, Frazee, MN, requested a variance to subdivide an existing 3.2-acre parcel into three
metes and bounds descriptions. Lots 1 and 2 will have 23,400 square feet of area and Lot 3 will have
47,700 square feet of area. It should be noted that all three lots will have easement rights for access,
an existing mobile home will be removed and the existing camping site will be terminated. Platted lots
on a recreational development lake require 150’ of water frontage and 40,000 square feet of area. The
property is described as a 3.2-acre tract in Government Lot 6, Section 27 of Hobart Township by Long
Lake. July 9,1998 meeting - The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Randall Mann, seconded by Cecil Femling and unanimously
carried, to table the variance request until the August 6, 1998 Board of Adjustment meeting for the
purpose of allowing the applicant additional time to consider the size of the proposed lots and the
access to the proposed lots. August 6,1998 meeting - The audience was not polled, as there were
no other people in attendance at the time of this hearing. After consideration and discussion, motion
was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to table the
applicant’s variance request until the August 13, 1998 Board of Adjustment meeting for review by the
County Attorney’s office of the applicant’s proposed road access to the proposed subdivison.
Paul and Heidi Moen -
Paul and Heidi Moen requested an extension of time for the removal of their water oriented accessory
structure from August 1, 1998 to August 31, 1998. After consideration, motion was made by David
Holmgren, seconded by John Everts and unanimously carried, to grant the additional time as
requested.
David Berg -
Motion by Randall Mann, seconded by Cecil Femling and unanimously carried to amend the minutes of
the June 4, 1998 meeting to read as follows:
To approve the subdivision of Lot 20, Wall Lake Point, noting that 6,400 square feet will be
permanently attached to Lot 21 with the balance of the Lot 20 being permanently attached to Lot 19.

Land and Resource Management,
Paul and Heidi Moen would like to request an extension of time for
removing our water oriented shed from August 1 to August 31, 1998. The
progress of our building onto the house is about five weeks behind schedule.
Paul has been unable to do physical work since 7-14-98 when he tore a muscle
in his leg and ended up on crutches. 1 spoke with Bill (Kalar- sp.?) on the
phone and he felt it wouldn’t be a problem providing we explained our
situation in a letter to the Land and Resource Management. We would
appreciate your consideration in this matter.
