It was noted that the granting of this variance would place the new dwelling no closer to the ordinary high water level than the existing structure. ^After additional consideration, motion was made by Cecil Femling, seconded by George Walter and unanimously carried to deny the subdivision of a 9,563 square foot parcel from an existing 51.13-acre parcel. It was noted that approving the subdivision would have created a parcel requiring variance for the applicant’s proposed plans. Hardship is a substandard lot of record and the granting of the above variance will provide the applicant with a reasonable use of his property. The following requests for variance, if approved, would make n possible for our family to update our cabin on Long Lake so that we can continue to enjoy the area. Variance Request #1. We request that Don Stenstrom be allowed to sell less than 5 acres from his 51.13 acres to Steve & Ruth Lorshbough. The proposed 9,563 sq. ft. would be permanently attached to form One parcel with Lot 7 Stenstrom Beach, 1st Addition on Long Lake, project we are proposing hinges on the approval of this variance. See attached drawing with proposed sale and its relationship to Lot 7. outlined in g^een ink. Variance Request §2 - Requests that Elizabeth Township be granted a variance which would allow Steve & Ruth Lorshbough to locate a sewage lift station near the end of a minimal travel, dead-end road right-of way. The dedicated road right-of-way is 33' wide. Most of this width is never used due to the small amount of traffic. See attached drawing. Variance #3 - Request a variance of 7 feet from the normal 10 foot setback to allow the construction of a 30' x 50' pole building on the property listed on variance request i?l above. Allowing the building to be construc­ ted 3' from the west and north property line, would result in the filling of less wetlands. See attached drawing. Variance request M - Request a variance of 5 feet from the normal lot line setback of 10 feet to construct a soil absorbtion area. See attached drawing. Variance request - Request a variance of 2' from normal 10' non­ residence building setback to allow construction of a soil absorbtion area. The absorbtion area would be 8 ft from the non dwelling 30' x 50' proposed pole building owned by Steve & Ruth listed in Variance Request #3 above. The soil absorbtion area would be installed on an easement granted to the Lorshboughs by Don Stenstrom on the north edge of the pole building Variance request #6 -Request variance of 10' from the norm.al 20' setback to allow the construction of a 30'x50' cabin 10’ from the Elizabeth Township dedicated road. This road has minimal travel and the cabin is near the road's dead end. A large swamp at the end of the road will stop the road from being continued in the future. See attached drawing. Variance Request §7 - Request a variance of 61 setback to allow the construction of the 3C’x50' cabin. This construction would be done in same lakeside footprint as the present cabin occupies. The current footprint is A7' from the O.H.W.L. on the east corner and 39' on the west corner. Don Hopper 736-7153 626 Highland Fergus Falls, MN 56537 TO WHOM IT MAY CONCERN: I have been neighbors with Steve and Ruth Lorshbough on Stenstrom Beach, Long Lake, for the past 10 years. I own Lot #8 next to them on Lot #7. I encourage the Otter Tail Land Management Office and the Otter Tail County Board of Adjustment to approve Steve and Ruth's requests for varience to rebuild their cabin at the existing distance from the lake. I understand it is now and would remain 39' on the west edge and 47' on the east edge. I also support their request for a 10' varience from the normal 20' road right of way setback to allow the expansion in size of their cabin to 30' X 50'. The 33' road right-of-way we have is much wider than any of us ever use to get to our cabins and since we are near the end of this dead end road there is very little travel on it. The road dead ends at the edge of a large swamp so I'm sure it will never be continued beyond our cabins or see increased traffic. I understand from Steve that some question on square footage of the proposed cabin size has been discussed. I do not feel this will be a problem as we will work together on the relandscaping to assure neither of us is adversely affected by the cabin size. We are writing in regards to the proposed addition to Steve & Ruth Lorshbough's lake property . We have the property next to theirs on lot 6. After looking at his plans, we know that the view of lake will not be restricted. We do. not object to their plans to build on to the back of their existing cabin. We currently have a low spot in between oiu’ cabins which collects water and with landscaping on both our lots, we will work together to keep water flowing gently to the lake. Our dead end roa.d, which has minirnal traffic, is maintained in the winter by the residents and not by the township or county. Currently Steve and myself have addressed the water problem with a pump system that keeps the back of our lot as dry as possible. An onsite visit today by Bill Kadar and myself revealed that the access road to the back lot is wider than was permitted. We also found that excess fill was placed along the North side of the township road adjacent to the storage shed, and neair your pole bam under the propane tank. Finailly, it would also appear that the amount of fill used for backfill around the dwelling exceeds the 20 yds3 allowed without a Grade & Fill Permit. Tlie height of the fill airound the dwelling is higher than the adjacent lots aind may create water problems for these lots. To remedy these problems all of the following work must be done by September 14, 2001: The width of the access road to the back lot must be narrowed to the permitted 10’ width. The fill must be removed along the North side of the township road ailong the existing tree line. The propane taink and fill under it must be removed from the wetland. The fill on the front lot around the dwelling can stay, provided a signed statement from the immediate adjacent property owners is rt ceived in this office. This statement must clearly say that they have no objection to the fill and the potential drainage/water problems they may incur because of the fill. 1. 2. 3. 4. I will place stakes where the fill needs to he removed if you Eire not clear on the areas spiecified in this letter. All fill that is removed must be placed outside of the shoreland area.
