RIGHT CP WAY EASEMENT
KNOW ALL MEN BY THESE PRESENTS, That the undersigned Charles T. Bertelsen and
Carol Jean Bertelsen, husband and wife of 18175 92nd Street SE, Fairmount, ND
58030 for and in <x>nsideration of One Dollar ($1.00) and other good and valu
able consideration grants and warrants to Dennis Petersen and Linda Petersen,
husband and wife. Grantee, of Ft. #1, Erhard, MN 56534 and to its successors and assigns, the perpetual right-oF-way and easement for the construction,
operation, maintenance, and repair of a jointly owned water and sewer system
either above ground or underground, including the necessary pipes, valves,
controls, well, lift station, septic tank, drain field, pump house and other
fixtures and apparatus in connection therewith the jointly owned water and
sewer system to be located per attached drawing along, upon, under, and across
the following described real estate in Otter Tail County, State of Minnesota.
Lots 16, 17, Swendsgaard Camp, Long Lake, Section 10, Township 134N,
Range 43W
The Grantor and the Grantee agree to the following conditions;
Shall have the right of ingre:i;s and egress for the purpose of carrying
out the easement and right-o:;-way granted hereby.
1.
Joint use of equipment and t)ni costs to maintain the equipment will be
shared equally by both Grantor.- and Grantee.
2.
Septic tanks and lift station will be pumped and maintained yearly to
remove silt.
3.
Electricity for well pump wi].i be provided by Grantee or the owner of
Lot 18, Swendsgaard Camp, Long Lake, Section 10, Township 134N, Range
43W.
4.
Electricity for lift station will be provided by Grantor or the owner of
Lots 16 & 17, Swendsgaard Cainj;), Long Lake, Section 10, Township 134N,
Range 43W.
5.
The Grantor covenants and agrees :liat he is well seized in fee of the lands
described herein, and has good right to grant and convey the rights of ease
ment herein granted, free and cleui: of all encumbrances, except t—
