Conditional Use Permit - Timberline Properties, LLC:
Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to build an access road to property on the west side of Mason Lake as presented. The
property is described as All GLS 4,5,7 & 8, NW1/4 SE1/4 & R GLS 2 & 3 Sublots, Section 22,
Elizabeth Township; Mason Lake (56-879), NE.
Closed to the Public
At 12:01 p.m., Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss litigation in the matter of denial of a variance for Cyril
and Cynara Stadsvold. The closed session is authorized by attorney-client privilege. Chapter 13D.05
Subd. 3b. Present were all five seated Commissioners, County Attorney. County Coordinator, Land &
Resource Director and Board Secretary.
Stadsvold Settlement Agreement
Upon conclusion of the closed session, at 12:14 p.m., Chairman Erickson declared the Board of
Commissioners’ meeting open to the public. Motion by Huebsch, second by Rogness, and
unanimously carried to authorize the Chairman’s signature to execute a Binding Mediated Settlement
Agreement between the County of Otter Tail and Cyril and Cynara Stadsvold in a matter of a decision
of the Board of Adjustment to deny a variance request.
Gambling Permit Approval
Motion by Lindquist, second by Froemming, and unanimously carried, to approve with no waiting
period, the LG220 Application for Exempt Permit as submitted by Lake Country Sportsman’s Club of
Otter Tail County for an event scheduled for Tuesday, February 16, 2010 at Amor Rumors
Restaurant.
WCRJC Meeting
Motion by Erickson, second by Froemming, and unanimously carried to request the County
Coordinator to attend the West Central Regional Juvenile Center meeting on Thursday,
October 22, 2009.
Adjournment
At 12:21 p.m.. Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners adjourned until Tuesday, October 27, 2009.

This letter is sent in regards to the above conditional use permit application request by
Timberline Properties, LLC. 1 have been neighbors with Timberline Properties, LLC, i.e., Dick
Field, for many years. 1 have seen a tremendous amount of time, effort, and expense going into
the farm owned by the applicant relative improving the property from an environmental
standpoint. 1 know there has been numerous trees planted, wild native grass planted and
restoring of wetlands over the years.
As an adjacent landowner and after review of all of the pertinent information, 1 have no objection
and would in fact support the request for the conditional use permit.
In addition, 1 would hope that the deciding entity would take into account the fact that the
applicant has been and continues to be a true steward of the land.

Dear Mr. Field,
As a result of the Violation issued for Grade & Fill work being done without a permit, our
Wetland Specialist, Eric Babolian, has visited your property. He requires that the following
items be restored as soon as possible.
Stabilization of the borrow areas where fill was removed.
Fill in borrow areas where fill was removed by the lake and wetland.
Removal of all debris placed in the wetland (trees, stumps, etc.)
Find the edge of the pre-existing road and identify it
Remove fill from the wetland that is wider than the pre-existing road.

When these items have been resolved, then you may submit your After-The-Fact
Conditional Use Application. The Planning Commission will view your property before the
meeting date. If they decide to allow your request, the work can be completed and the
violation will be resolved.
There is the possibility that they will deny the request. The issue can be readdressed at
that time if necessary.
If you have any questions, please contact myself or Eric. Also, if the work is complete,
please contact our office so it can be inspected.

Mr. Field,
On September 18,2009 the Technical Evaluation Panel (TEP) was onsite to verify the
removal of fill material from the wetlands and also verified the disturbed areas have been stabilized
as per our onsite conversation.
With that said, it appears the Wetland Conservation Act (WCA) violation is resolved. Thank
you for your cooperation in this matter.
