Donald & Joann Houge;
On October 9, 2019 the Planning Commission passed a motion to recommend approval of your
request. Their motion is as follows;
A motion by Boyer, second by Fischer to approve as presented, provided: 1. The Applicant
provides stabilization, erosion control & drainage plans to Land & Resource Management for their
approval. 2. Earthmoving takes place between April 15*^ and October 1®\ with implementation of
appropriate erosion control measures. 3. The road design is approved by the Township. 4. The
Permit will be valid for 3 years. 5. The contractor must meet with Land & Resource Management
Staff for preconstruction approval.
On October 22, 2019, the County Board of Commissioners passed a motion to approve the request
as recommended by the Planning Commission.
As you can see, there are conditions placed on this approval. Once these conditions are met, our
Office will process your Conditional Use Permit.

Meeting of the Otter Tail County Planning Commission was held on October 9, 2019 at 6:30
P.M. in the Commissioner’s Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Rod Boyer, Judd Fischer, Jack Rosenthal, Bruce Stone, David Trites,
David Wass and Rick Wilson.
Members Absent: Brent E. Frazier, Richard Gabe and Bert Olson.
Michelle Eldien represented the County Attorney's Office and Kyle Westergard represented
the Land & Resource Management Office.
Minutes of September 11, 2019: A motion by Wass, second by Fischer to approve the
September 11,2019 Minutes as presented. Voting: All members in favor.

A Conditional Use Permit Application (as stated by the Applicant on the Application):
Proposing to cut 1840 cubic yards of soil off of 2 Parcels and place on 35 Acre Parcel. Parcel
No. 22000130099010 - Cut A - Will be approx. 80’ x 100’ x 2.5’ = 740 cubic yards. FILL in
RROW - Will be Approx. 250 cubic yards (100’ x 25’ x 2.5’) which is approved by Elizabeth
Twp: Parcel No. 22000130099013 - Cut B - Will be Approx. 60’ x 100’ x 5’ = 1111 cubic
yards; Parcel No. 22000130099000 - Spoils from the cuts will be used to fill in 2 hollow areas.
Fill Area #1 - 130’ x 65’ x 3’ = 938 cubic yards; Fill Area #2 - 160’ x 35’ x 3’ = 622 cubic yards;
Extend Approach Area 25’ x 12’ x 3.5’ = 39 cubic yards. Old Road-Bed - Place approx. 5” of

Board of Commissioners Meeting Minutes
October 22, 2019
County Attorney Michelle Eldien stated if Commissioners choose to disagree with the ditch viewers, it is
required to provide specific findings as to why they find the outcome inappropriate and a basis as to why
ditch viewers did not follow statute, specifically Minn. Stats. 103E.311 and 103E.315.
At 10:34 a.m. the public hearing is closed.
Commissioner Johnson commented that they do not have reasons to disagree with the ditch viewers findings
and have not determined that ditch viewers are not following statutes. He confirmed the water above (Eagle,
Torgerson, and Middle Lakes) was draining into Jolly Ann Lake before Ditch 52 was created to help maintain
the water level on Jolly Ann.
A motion was offered by Johnson and seconded by Rogness to accept the amended viewers report as presented. jf:

authorized under M.8.130:05, Subd.3(b). Present were ^11 fivb seated Commissioners, Attorney Michelle
Eldien, Administrator John Dinsmore, Internal Services and Internal Services/HR Director Nicole Hansen,
County Engineer Charles Grotte, Public Works Diredtor Rick West, Assistant County Engineer Matthew
Yavarow, Board Secretary Tara Bakken and Kendra^QIson with Pemberton Law Firm.
The closed session was conciqded at 11:04 a.m.

Proposed Project:
I. The cabin will be removed
2. An area 100' x 80' x 2.5' deep (740 cubic yards) soil to be removed. Starting at crown of hill and
going north sloping at a rate of I" every 10' to the north away from the lake. The area bordering my
neighbor on the west will be sloped gently downward at a rate of 5' per 1' of elevation away from him.
3. Grass seed will be planted and a straw mat will be placed at the crown of the hill and shredded
straw will be placed on the remainder.
4. This area has stakes with red painted tops.
5. At the base of the hill 20' from the lake, we propose to place 4"-6" of black dirt on an area
30'xl00'. This area was an old township road bed until 1966.
6. A silt fence will be placed between this described area and the lake. Grass planted, a straw mat
placed on the lake side of the dirt with shredded straw on the remainder.
Lot #2 directly east and contiguous to lot #1 reference #R22000130099013, the cabin lot or lot #1
The small shed at the north end of this lot will be removed.1.
2. We propose to remove an area about 60' x 100' x 5' deep. Area of 1111 cubic yards. This area
has stakes which have been painted biue at the top. We would remove the dirt using the same
preventive measures as described in Lot #1. At the crown of the hill both on lot #1 and lot #2 with either
a back hoe or cat with a 6 way blade would be used to move the dirt away from the crown of the hill to
prevent any dirt falling toward the lake.
3. Again we would like to add 4" to 6" of black dirt on the old township road bed to provide a
good bed for grass growth. This would also be on an area of 30' x 100' -20' from the lake with a silt
fence to prevent any dirt from entering the lake. Using a straw mat on the lake side of this area and
shredded straw on the remainder. Lot #1 plus this area (lot #2) has white top painted stakes.
The soil that is removed from lots 1 and 2 will be moved to the following areas: 111 cubic yards of black
661 cubic dirt will be placed on the old road bed. This area has stakes with white painted tops. 250
cubic yards will be moved just north of Lot #1 and north of township road (Hazelwood Trail) providing a
gentle slope at a rate of 5' slope per 1' of elevation. A silt fence will be placed between all areas where
dirt has been placed and the wetland thus protecting the wetland. All appropriate surfaces will be
planted with grass, straw mats piaced on the edges and shredded straw covering the grass seed. This
area will be shown by stakes with green painted tops. 938 cubic yards will be moved to the area behind
the old granary - reference #22000130099000. This is shown on the scale drawing form as primary
hollow and will have stakes with green painted tops. Any remaining dirt wili be placed across the
Jewett Lake road directly north of the road and east of the steel gate across from my driveway. This
staked area will accommodate 661 cubic yards of dirt. Stakes with green tops will show this area. This
is shown as secondary holiow on the scale drawing form.

The Detroit Lakes MPCA office recently received the attached notice of public hearing for the October 9, 2019 Otter Tail
County Planning Commission meeting. MPCA staff has no specific comments on the proposed project, other than to
inform the county that Jewitt Lake (56-0877-00) is proposed to be listed as impaired on the MPCA's 2020 Inventory of
Impaired Waters. Jewitt Lake failed to meet impairment thresholds for fish bioassessment monitoring as part of the
Otter Tail River Watershed Restoration and Protection Strategies (WRAPS) process, and will therefore be listed as
impaired for Aquatic Life.
