After discussion and consideration, Paul Larson made a motion, which was seconded by Rick Wilson to approve the variance as
requested. This motion failed with Thomas Lee, Darren Newville and Steve Schierer voting no. After additional discussion and
consideration, Paul Larson made a motion, seconded by Thomas Lee and unanimously carried, to approve the location of the 28’
by 48’ three-bedroom two bath dwelling as shown on the drawing submitted with the revised application, which places the north
lake side of the dwelling 43’ from the ordinary high-water level and the south lake side of the dwelling 52’ from the ordinary
high-water level and to deny the requested variances for the proposed deck. It was noted that the deck could be placed on either
the north or south end of the proposed dwelling if it is no closer to the ordinary high-water level than the proposed dwelling and if
all other ordinance requirements for the deck placement/location are met. The variance as approved will provide the applicants
with a reasonable use of their property. Hardship/practical difficulty is the terrain of the applicants’ property.

The Otter Tail County Board of Adjustment met Thursday, December 14, 2017, with the following persons in attendance:

Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the November 9, 2017 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Jerry Thompson - Variance application approved as requested. 6:32 p.m.
Jerry Thompson, Survey Lots of Government Lots 5 and 6, Section 33 of Tordenskjold Township by Stalker Lake, requested the
following: Keep 16’ by 30’ storage building in current location which is 20’ from traveled surface and 15’ from road right-of-
way. Matt Hoen represented the applicant at the public hearing. The audience was polled with the following individuals
expressing concerns with the variance application and the location of the structure: Leann Tangen, Keith Deblieck and Diane
Deblieck. The existing easement and concern for public safety were concerns that were noted. Leann Tangen presented copies of
Document Nos. 727547 and 907279, a page from an abstract to title, two photographs displaying the road, building and parking
area and a map of current ownership to support her argument that the property owner should have known the location of the road
right-of-way and the required setback. These documents have been placed in the applicant’s file for establishment of the
permanent record. After consideration and discussion, Darren Newville made a motion, seconded by Thomas Lee and carried
with Paul Larson voting no, to approve the current location of the 16’ by 30’ storage building, which is presently located 20’ from
traveled surface and 15’ from the road right-of-way. It was noted that the applicant and the applicant’s representative acted in
good faith, attempted to comply with the provision of the ordinance, the benefit to county by requiring compliance would not
exceed the cost to comply and the structures location is very consistent with the location of other similar structures in this
immediate area.

Timothy and Paul Brusven Et. Al., part of Government Lot 3, Section 12 of Elizabeth 'fownship by Long Lake, requested the
following: Requirement 100’ setback from lake. Presently have a 14’ by 60’ mobile home on lot with a setback of 66’ from lake
on south end and 57’ from north end of home. Wish to remove and replace with home 28’ by 48’. This would put home 52’ from
lake on south end and 43’ from lake on north end. There is no building to the south of us and there is a high bank and woods to
the south of our lot. Not suitable for building. The home to the North of our property is about 20’ closer to the lake. Also
proposing to add a 15’ 5” by 19’ 9” deck and a 6’ by 19’ 9” catwalk no closer than 34’ 7” from the ordinary high-water level.
Representing the applicants at the public hearing were, Timothy Brusven, Joan Brusven and Paul Brusven. The audience was
polled with Richard Ouren speaking in support of the variance as requested. After discussion and consideration, Paul Larson
made a motion, which was seconded by Rick Wilson to approve the variance as requested. This motion failed with Thomas Lee,
Darren Newville and Steve Schierer votmg no. After additional discussion and consideration, Paul Larson made a motion,
seconded by Thomas Lee and unanimously carried, to approve the location of the 28’ by 48’ three-bedroom two bath dwelling as
shown on the drawing submitted with the revised application, which places the north lake side of the dwelling 43’ from the
ordinary high-water level and the south lake side of the dwelling 52’ from the ordinary high-water level and to deny the requested
