Jon B. Olson - Variance application approved as requested. (7:05 p.m.)
After consideration and discussion, Rod Boyer made a motion, second by Ward Uggerud and unanimously carried, to
approve a variance of 30’ from the required bluff setback of 30’ and a variance of 18’ from the required ordinary high
water level setback of 100’ for the placement of the proposed development as described in the variance application
dated March 10, 2016 and as depicted on the drawing submitted with the variance application 82’ from the ordinary
high water level and 0’ from the bluff. The variances as approved will provide the applicant with a reasonable use of
the property. This is a unique property and if the proposed development is done properly it will have no negative
impact to the lake or the surrounding area. The hardship/practical difficulty is the terrain of the applicant’s lot. It was
also noted that there is no other location for the development being proposed. The variances as approved do not
directly or indirectly grant any other variances for the proposed development.

Township 134, Range 43, Excepting therefrom the West 60.5 feet of the South 137.0 feet thereof; and
also Excepting the following described tract: A part of Government Lot 4, Section 11, Township 134
North, Range 43 West, Otter Tail County, Minnesota, described as follows: Commencing at the
Northwest corner of said Section 11, thence South 2081.5 feet along the West Section line thereof;
thence South 85 degrees 18 minutes East 695.31 feet; thence South 528.9 feet to the point of beginning;
thence South 57.06 feet; thence East 60.5 feet; thence in a northwesterly direction to the point of
beginning.
EASEMENT A: Together with and subject to a 20.00 feet easement for ingress and egress over and
across part of Government Lot 4, Section 11, Township 134 North, Range 43 West, Otter Tail County,
Minnesota. The centerline of said Easement is described as follows: Commencing at the intersection of
the East line of the West 28 Rods (462 feet) of said Government Lot 4 with the Southerly Right-of Way
line of County Road Number 27; thence on a bearing of South along said East line a distance of 325.16
feet to the point of beginning of said centerline; thence North 39 degrees 22 minutes 47 seconds West
37.99 feet to a point hereinafter designated as Point A; thence continuing North 39 degrees 22 minutes
47 seconds West 138.30 feet; thence North 45 degrees 44 minutes 46 seconds West 146.59 feet; thence
North 43 degrees 32 minutes 17 seconds West 130.33 feet; thence North 04 degrees 42 minutes 00
seconds East 14.31 feet to the south Right-of-Way line of County State Aid Highway Number 27 and said
centerline there terminating. The sidelines of said easement are to be lengthened or shortened to
terminate on the southerly Right-of-Way line of said County Road Number 27 and at the East line of the
West 28 rods (462 Feet) of said Government Lot 4.
EASEMENT B: And also together with and subject to a 20.00 feet easement for ingress and egress over

County, Minnesota. The centerline of said Easement is described as follows: Beginning at the afore
described Point A; thence South 06 degrees 25 minutes 08 seconds West 64.31 feet to a point
hereinafter described as Point B; thence continuing South 06 degrees 25 minutes 08 seconds West
71.94 feet: thence South 15 degrees 56 minutes 43 seconds East 95.74 feet; thence South 82 degrees
50 minutes 12 seconds East 14.28 feet to the East line of the West 28 rods (462 feet) of said
Government Lot 4 and said centerline there terminating (this is referred to as Point B in the grant of the
easement between Leona Nickel and Richard Nickel in the original Deed of Appurtenant Easement). The
sidelines of said easement are to be lengthened or shortened to terminate on the southerly Southwesterly
line of the afore described Easement A and at the East line of the West 28 rods (462 Feet) of said
Government Lot 4.
And also together with and subject to a 15.00 foot wide easement for ingress and egress over and across
that part of Government Lot 4, Section 11, Township 134 North, Range 43 West, Otter Tail County,
Minnesota said 15.00 foot wide easement being 15.00 feet wide and lying northeasterly and adjacent to
the following described line: Commencing at the northwest corner of said Section 11; thence South,
assumed bearing along the west line of said Section 11, a distance of 2081.5 feet; thence South 85
degrees 18 minutes 00 seconds East 463.54 feet; thence South 335.76 feet to the point of beginning of
the line to be described; thence South 45 degrees 03 minutes 00 seconds East 265.48 feet; thence South
59 degrees 20 minutes 00 seconds East 50.15 feet and there terminating. The sidelines of said easement
are prolonged or shortened to terminate at the boundary lines at the point of beginning and at the point of

Jon B. Olson, part of Government Lot 4, Section 1 f of Elizabeth Township by Long Lake, requested the
following: I am requesting a 30’ variance to the bluff setback to be 0’ from the bluff and an 18’ variance
from the 100’ ordinary high water level setback to be 82’ for the construction of an addition and deck. The
addition will be no closer to the lake than the existing 1938 structure. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion. Rod Boyer made a

Steve and Kathy Barnes - Variance application approved as requested. (7:10 p.m.)
Steve and Kathy Barnes, Lot 7 Bill’s Beach First Addition in Edna Township by Big McDonald Lake,
requested the following: Construct screened in porch over existing concrete slab - lake side of porch will be
approximately 45’ from ordinary high water level. The applicants were represented by Kathy’s uncle
(Robert). The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Thomas Lee made a motion, second by Ward Uggerud and unanimously
carried, to approve a variance from the required ordinary high water level setback for the construction of a
screened in porch over an existing concreate slab as stated in the variance application dated March 15, 2016
and as depicted on the drawing submitted with the variance application. The proposed development is no
closer to the ordinary high water level than the existing development and there will be no change to the
impervious surface coverage. It was also noted that the proposed development is similar use to other
properties in this immediate area. The variance as approved does not directly or indirectly grant any other
variances for the proposed development.
Thea Rothmann and Guy Griebe - Variance application approved as modified. (7:15 p.m.)
Thea Rotlunami and Guy Griebe, part of the Southwest Quarter of the Northeast Quarter and part of
Government Lot 2, Section 18 of Everts Township by Third Silver Lake, requested the following: Request
is for a 3 foot (instead of 10 foot setback) from adjacent lot to the west (parcel # 25-000-18-0103-004).
Requesting a variance of 7’ from lot line. A letter form Nate and Melanie Herrington in support of the
applicants’ proposed development was noted for the record. The audience was polled with no one speaking
for or against the variance as requested. The applicants noted that they required only a 5’ variance instead
of the 7’ variance as stated in the application. The original measurement was from the overhang and not
from the wall of the proposed development. After consideration and discussion. Ward Uggerud made a
motion, second by Thomas Lee and unanimously carried, to approve a variance of 5’ from the required side
lot line setback of 10’ for the placement of the proposed house addition and attached garage 5’ from the side
lot line as depicted on the drawing submitted with the variance application. Hardship/practical difficulty is
the terrain features of the applications’ property. The variance as approved does not directly or indirectly
grant any other variances for the proposed development.
