screen porch being 60 ft from OHWL on East side of dwelling. Dwelling currently is 43 ft from OHWL.
Required setback is 100 ft from OHWL. Also requesting to increase SIZ impervious surface coverage from
508 sq ft to 588 sq ft. Maximum allowed coverage is 260 sq ft. Second story addition was approved by
variance in 2008 and a 16x24 section of the house was removed, proposed deck and porch will cover
less area than the removed section.

determination that a practical difficulty exists is based upon consideration of the following criteria:

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. {Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.
Steven & Barbara Diederick - Variance Application Approved with Conditions (6:22 p.m.)
Steven & Barbara Diederick, Lot 6 Blk 1 of Walvatne’s Addn-Pleasant Grove, Ottertail Lake (56-242) in Amor Township requested
the following: Proposed to have Lot 6 Blk 1 of Walvatnes Addition to Pleasant Grove be declared buildable. The Plat w as recorded
November 18, 1977. The lot size is 100’ x 200’ = 20,000 sq. ft. The required size for a backlot to be buildable is 200’ of lot width and
40,000 sq. ft of lot area. The proposed building will meet the requirements of the Shoreland Management Ordinance.
Steven & Barbara Diederick, property owners represented the variance application via Microsoft Teams. The audience was polled
with no one speaking for or against this application.
After consideration and discussion, Thomas Lee made a motion, seconded by Douglas Larson and carried by roll call vote to approve
the variance request to have Lot 6 Blk 1 be declared buildable with the condition that the structure is a non-dwelling structure and that
they legally attach Lot 6 Blk 1 to Lot 23 of Pleasant Grove, Parcel No. 02000990478000 (Riparian Lot). This decision is based on the
Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s finding have been attached to and
incorporated as an official part of the minutes which have been placed on file with the Land & Resource Management Department.
