Dear Mr. Houge:
On May 5> 1976 I issued you a special use permit, numbered
1277j to build 8 driveway and fill an old road bed on your-
property.
Since that time it was brought to my attention that the
lower portion of that road bed serves as a reservoir for
run off water and if it were completely filled the reservior
would be decreased in size to a point that it may flow
over a retaining wall on Bud Kruchtens property causing
flooding of his home. This oversight on my part has caused
me to re-evaluate your permit before you commence work.
Therefore, I am revising your special use permit No. 1277 to read that no fill shall be placed in the old roadway (drainage)
closer than 35 feet north of the fence (property line) crossing
the ditch. This will allow the maximum amount of reservoir
that can be held by the existing retaining wall.
If you intend to fill within 35 feet of the Kruchten property
you must apply for a special use permit to be decided on by the
Planning Commission and County Board.

To Whom it May Concern;
In reference to the letter from Land & Resource Management, Malcomb E, Lee,
Administrator, dated May 14, 1976; also .in reference to your revising your
special use permit No, 1277» the former Bud Kruchten (816 N, Vine) property
has been sold to Wallace P, & Phyllis A, Schulz, Wallace P, & Phyllis A, Schulz
have given David L, & Rebecca C, Houge and also the Land & Resource Management
office, CoTinty of Otter Tail, permission with no liability to fill stated
ditch anyway they so choose and will not be held responsible for water damage
or any other damage as a result of filling the ditch now or forever.
David L, & Rebecca C, Houge hereby agree to allow Wallace P, & Phyllis A, Schulz
to build within one foot of the below conveyed land.
A rectangular tract of land 21 feet 8 inches by 35 feet located in Government
Lot 1, Section 10, Township 134 North ot Range 43 West, described as follows, viz:
Commencing at Meander Corner No. 31 on the East 1-ine ol said Section 10, which
Meander Corner is 459.36 feet south of the East Quarter Corner of said Section 10;
thence south 89°42 west a distance of 602.2 feet to an iron stake; thence north 11°
32 east 53.0 feet to the place of beginning of the rectangular tract of land here
by conveyed; thence at a right angle to said last mentioned line 21 f<H>t 8 inches
westerly; tfience north 11^^32 east 35.0 teet; thence at a right angle to said last
