Pursuant to adjouminent, the Board of County Ccttinissioners of Otter Tail
County met Friday, December 5, 1986. Chairman Olson opened the meeting
at 1:08 p.m. with all members present.
IINUTES APPROVED Upon motion made by Andy Lindquist, seconded by Bert. Ifcivland and unani
mously carried, the minutes of the Novenber 25th meeting were approved
as mailed.
'ORGIVENESS OF PENALTY
jENIED
Alvin Gehrke, Western Township, appeared before the Board requesting
forgiveness of penalty on a late pai-ment of tax, stating payment was
mailed at the postoffice on the 15th of November but not postimrked
until the 18th. After consideration, motion was made by Andy Lindquist
to deny forgiveness of penalty, stating a precedent would be set in so
granting. The motion was seconded by Bert Hovland and carried with
Sydney Nelson and Hub Nordgren voting "no".

LOSURE
Malcolm Lee, Solid Waste Officer, presented the disposal site closure
record on the Ottertail Landfill, with a closure date of'September 15,
1986.

Meeting of the Otter Tail County Planning Commission was held bn December 3,
1986 at 7:00 P.M. in the Government Services Building, 505 South Court
Street, Fergus Falls, Minnesota 56537.
Members Present: Cecil Femling, Reba Lee, Bert Olson, Richard Portmann,
Robert Schwartz, Tom Stringer, David Trites.
Members Absent: Frank Lacbowitzer, Victor Petterson Jr., June Ryan.
Approved; A motion by Trites, second by Femling to approve the minutes of
the November 5, 1986 meeting as mailed.
Voting; All members in favor.
Denied; A motion by Stringer, second by Portmann to deny the conditional
use application of Helen F. Serumgard. Douglas Jensen (Agent).
Stuart Lake, No. 56-191, RD, on Sub lot A of Government. Lot 3,

to the commission.

fill is placed closer than 16 feet of the ordinary high water
mark. 2. That no fill will be higher than 6 inches below the
lowest point of the lakeside ridge. 3. That the Army Corps of
Engineers is consulted and if this area is in their
jurisdiction, their approval is needed. 4. The fill to be used
must be "clean fill".
Voting; All members in favor.
A motion by Trites, second by Portmann to approve the
preliminary plat of Roger Wollschlager & Margaret Ness. Stuart
Lake, No. 56-191, RD, of Out lots A, B & C and Lot 1 of Stuart
Lake Park, Section 34 of Girard Township with the condition that
the road constructed in 1980 (between the old road and the new
construction) and that area be restored to the original level as
soon as feasible following the District Court Vacation of the
road. Terry Anderson and George Stone spoke to the commission.

SPECIAL CONDITIONS OF NATIONWIDE PERMITS
(1) That the diecbirge will not be located in the proximity of a public
water aupply intake;
/(2) That the diacharge will not destroy or jeopardise a'threatened or
endangered species as identified under the Endangered Species Act, or destroy
or adversely modify the critical habitat of such species. In the case of
Federal agencies, it is the agency's responsibility to review its activities
to determine if the action "may affect" any listed species or critical habitat.
If so, the Federal agency must consult with the Fish and Wildlife ^Service
and/or the National Marine Fisheries Service,
(3) That the discharge will consist of suitable material free from toxic
pollutants in toxic amounts;

(4) That the fill created by the discharge will^be properly maintfiiied
to prevent erosion and other non-point sources of pollotion;^^^^^'-*^ tn
a(5) That the discharge will not occur in a component of the National

THESE MANAGEMENT PRACTICES SHOULD BE FOLLOWED
TO MINIMIZE ADVERSE EFFECTS ON THE AQUATIC ENVIRONMENT
(1) Discharges of dredged or fill material into waters of the United ptatea
shall be avoided or minimised through the use of practical alternatives;
(2) Dischargee in spawning areas during spawning seaaons shall be avoided;
(3) Discharges aball not restrict or impede the movement of aquatic
species indigenous to the waters or the passage of normal or expected high flows or causa the relocation of g^e water (unltP* (kf primary purposejBf^tho

(4) If the discharge creates an impoundment of water, adverse impacts on
the aquatic system caused by the accelerated passage of water and/or the
restriction of its flow, shall be minimised;
(5) Discharge in wetlands areas shall be avoided;
(8) Heavy equipment working in wetlands ehall be placed on mats;
(7) Discharges into breeding areas for migratory waterfowl shall be avoided;
(8) All tenporary fills shall be removed in their entirety.
