Conditional Use Permit- Patrick Peck:
Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use Permit for
a private boat access as presented. The project is located in the SI/2 NE1/4 SW1/4, SW1/4 SW1/4 &
SI/2 of Lot 3 (79.75 AC), Section 20 of Scambler Township: Rankle Lake (56-935), NE.
Conditional Use Permit - Dustin & Rachel Ebersviller:
Motion by Huebsch, second by Johnson, and unanimously carried to approve a Conditional Use Permit for
a zoo to be developed in accordance with all government requirements on the applicant’s property as
presented. The project is located in the SW1/4 NW1/4, Section 10 of Candor Township; Unnamed Lake
(56-533), NE.

Conditional Use Permit - Tami Bover and Robert & Terri Lanalie:
Motion by Rogness, second by Johnson, and carried with Johnson abstaining to approve a Conditional
Use Permit to cut part of a hill by the lake area for better access as recommended by the Planning
Commission. The proposal is located on Lots 14, 15 & 16 Freedom Flyer Estates, Section 29 of Hobart
Township; Long Lake (56-388), RD.
OCTA Trail Route Reduction
A Grant-in-Aid Trail Permit form was provided by MN DNR to Bill Kalar, Land & Resource Director, to be
signed. Mr. Kalar requested this matter be delayed due to conflicting interests that need to be addressed.
Mr. Kalar will reschedule this matter once resolution has occurred.
Subsurface Sewage Treatment Rules
Commissioners discussed the State's Subsurface Sewage Treatment (SSTS) as set forth in Minnesota
Rules Chapters 7080 through 7083, which are also contained in what is commonly referred to as the
“Purple Book.” Discussion was held with Bill Kalar, Land & Resource Director, regarding the State rules
compared with the Otter Tail County Sanitation Code.
Bid Award - CSAH 35
After previously advertising for bids for S.A.P. 056-635-033, bids were opened on May 20, 2015, at the
GSC in Fergus Falls, MN. Motion by Johnson, second by Rogness and unanimously carried to award the
Bituminous Milling, Wear Courses, Aggregate Shoulders and Topsoil project to the low bidder, Tri-City
Paving, Inc., of Little Falls, MN, at the bid amount of $2,113,272.72, as recommended by the Public Works
Director.
Bid Award - CSAH 65
After previously advertising for bids for S.A.P. 056-665-009, bids were opened on May 20, 2015, at the
GSC in Fergus Falls, MN. Motion by Foemming, second by Johnson and unanimously carried to award the
Full Depth Reclamation and Bituminous Overlay project to the low bidder, Tri-City Paving, Inc., of Little
Falls, MN, at the bid amount of $1,570,880.54, as recommended by the Public Works Director.
Amendment to Proposal - CSAH 38 MPCA Permit and EAW Preparation
Rick West, Public Works Director, presented that Bolton & Menk, Inc., of Burnsville, MN, conducted a
preliminary visual inspection of CSAH 38 Reconstruction Area of Potential Effect. During this inspection,
several areas were identified as requiring subsurface testing because archaeological materials may be
present. Motion by Johnson, second by Rogness and unanimously carried to authorize an amendment to
the original proposal for CSAH 38 to amend this service agreement to include an archaeological Wrveya^
presented by the Public Works Director.0*-

Dustin & Rachel Ebersviller- Approved With A Condition:
A Conditional Use Permit Application (as stated by the Applicant on the Application): I would like to
make my property into a zoo in the Detroit LakesA/ergas area. It will be a Licensed USDA
facility following all USDA guidelines. It will be built in 4 phases and will be a total of 40
acres. Phase 1 will have 20 species on about 10 acres. It will have 20 - 30 parking spaces
and will be completed late summer of 2015. The zoo will be open Memorial Day - Oct. 31,
7 days a week, 10 am - 6 pm weather permitting. There is a projected 10,000 - 15,000
people annually to visit the Zoo. Phase 2 will be completed by Spring 2018, with 40 species
on 20 acres and 50 parking spaces. Phase 3, 30 acres and 60 species by 2020. Phase 4,
40 acres and 80 species completed by 2024. The project is located in the SW1/4 NW1/4,
Section 10 of Candor Township: Unnamed Lake (56-533), NE.
Dustin & Rachel Ebersviller represented the Application.
David Ebersviller, closest neighbor, indicated that he has livestock and does not have any
concerns regarding this request.
Motion: A motion by Wass, second by Rosenthal to approve as presented, provided ail
government requirements are met and their permits are received. Voting: All Members in
favor.
Jerome M. & Patricia J. Kirscht - Approved With Conditions:

a permit to operate our business. Northern Plains Retrievers, on the property located at

April 15, 2015 - Planning Commission Motion: A motion by Schwartz, second by Gabe to
deny the request, due to the lack of specificities to make a determination on the

We will be renovating one of the existing buildings on the property to use as a kennel
building. Although we will not be changing the structure of the building, the renovation
will allow for drainage for cleaning kennel runs, and will require a holding tank or septic
tank and drain field.
Northern Plains Retrievers is a professional gun dog training facility, and a Labrador Retriever
breeding facility, that was formally started in 2007. The owners, Wade and Julie Stottler, have
been in the gun dog training and breeding business since 2003. Both owners have held full-time
jobs during our business’s growth. Wade has worked 27 years as a high school teacher and
coach, while Julie has worked as an administrative support specialist for over 30 years. We
started the business as a way to earn some income during the summer, and because it was
something our two sons could participate in as well.
Northern Plains Retrievers offers professional gun dog training for retrievers, we offer trained
dogs for sale, we breed and raise Labrador Retriever puppies to sell, we handle client dogs in
hunt tests, and we use our dogs to guide pheasant hunts at a hunting lodge in South Dakota,
Compatibility - Rural Minnesota has a large number of waterfowl and upland bird himters that
can benefit from our services.
Environmental Impact - Our facility will have a minimal impact on the environment. We won’t
be removing any vegetation or changing the landscape. Waste from the kennel will either be
cleaned by a septic system or pumped out and removed.
Hazards - No hazards will be created on land or water.
Suitability - we will not have to change the property to operate our business. We will also be
haying a fair number of acres, which is what the land has mainly been used for during the last 15
years.
Parking - There is adequate parking space in front of the kennel building to meet our needs.
Traffic - Clients bring their dogs to our facility and leave them there anywhere from six weeks to
six months for training. Most owners only visit our facility twice, once when dropping off and
once when picking up. Occasionally we vrill also have people picking up puppies.
Noise - our dogs will be housed in indoor runs. The main kennel building has 6-inch foam
insulation in the ceilings and walls, and the inside walls are covered in % inch plywood. The
dogs will be outside to exercise and train, but since that is where they want to be, barking will be
minimal. The part of the property we will be doing most of the training on is on the east side of
the hill the property lies on, while our closest neighbors are on the west side of the hill.
Additionally, there is a thick band of woods on the west side of the property working to keep
sound in.

Hours - The hours we work vary depending on the time of year. Generally, we don’t start
training until dog chores are done, usually around mid-morning. We are usually done training by
late afternoon or early evening, then feed and exercise the dogs before supper.
Lighting - The only additional lighting we might add would be on the north and south sides of
the kennel building. This would be directed at the ground so we can keep track of dogs if we are
exercising them after dark., Usually that is only during winter months. It should not be visible to
our neighbors.
Signage - There v^ll be one lit sign by the driveway at the entrance to the property, no bigger
than 3’ X 4’. Again, the sign will be on the east side of the hill and the nearest neighbors are on
the west side, blocking them from seeing it.

Lot Area - The 36.5 acres will allow us to do a fair amount of our training on the property, (our
current facility is on 5.5 acres). We will also travel to other locations to use different types of
terrain and water for training purposes.
