Motion
Zion EV Lutheran Church - Approved the variance application as requested with conditions. (9:04 p.m.)
After discussion and consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously carried,
to approve a variance to subdivide by metes and bounds description an existing 3.87 acre parcel into two tracts as
described in the variance application dated May 10, 2006 with the following conditions: 1.) a registered surveyor’s
drawing must be presented at the time of conveyance, 2.) a well easement maintenance agreement must be prepared
and recorded, and 3.) before the proposed subdivision can be recorded both parcels must have certified septic
systems installed unless the house is removed in which case only the parcel containing the church must have a
certified system.

After additional discussion and consideration, Cecil Femling made a motion, second by Steve Schiererto
deny the variance as requested. It was noted that approving the variance as requested would create a
situation where more than 25% of the total lot area would be covered with impervious surfaces. After
additional discussion this motion was withdrawn. After additional review, Steve Schierer made a motion,
second by Paul Larson and unanimously carried, to table, with the verbal permission of the applicants, this
variance hearing until the July 6, 2006 meeting of the Board of Adjustment to provide the applicants an
opportunity to review there proposed development plans, to assure that no more than 25% of the total lot
area will be covered with impervious surfaces and to develop a plan that contains a legally located septic
system.
Michael J and Mary Casey - Approved the variance application as requested with a condition.

Michael J and Mary Casey, Lot 7 Pulford’s Beach Addition, Walker Lake in Amor Township, requested a
variance of 49’ from the required ordinary high water level setback of 100’ for the placement of dwelling 5T
from the ordinary high water level. The audience was polled with no one speaking for or against the
variance as requested. A letter signed by Marc Wing, Gerald and Sharon Cuhel, Thomas and Doris
Pulford, Larry and Connie Ediund and Stewart Guffey in support of the variance as request was read for
the record. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and
carried with Cecil Femling voting no, to approve a variance of 49’ from the required ordinary high water
level setback of 100’ for the placement of dwelling 51 ’ from the ordinary high water level with the condition
that the existing shed must be placed in a compliant location on or before September 30, 2006.

Zion EV Lutheran Church, part of the Southwest Quarter of the Southeast Quarter, Section 10 of Effington
Township, requested a variance to subdivide by metes and bounds description an existing 3.87 acre parcel
into two tracts. One tract would be approximately 1.58 acres and the other would be approximately 2.3
acres. The minimum size required for a metes and bounds parcel in a non shoreland area is 2.5 acres.
The minimum size required for platted lots in a non shoreland area is 120’ of width and 20,000 square feet
of area. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously
carried, to approve a variance to subdivide by metes and bounds description an existing 3.87 acre parcel
into two tracts as described in the variance application dated May 10, 2006 with the following conditions:

Rick and Laura Heinie, part of the Southwest Quarter of the Northwest Quarter and Government Lot 3,
Section 23 of Rush Lake Township by Rush Lake, requested the following: Mathematics used to calculate
boat slips for a planned unit development (PUD) allowed 2 slips for Pleasure Land Estates a 20 single
family unit development. My request due to lay of land and potential 10 unit concession is for 10 total slips.
One-half usage of plat as approved. The audience was polled with Dennis Doran expressing concerns
with the variance as requested unless the number of units approved by the Planning Commission is
reduced. A letter from Terrence R. Lejcher, Area Hydrologist with the Minnesota Department of Natural
Resources in opposition to the variance as requested was read for the record. A letter from Stephen
Ludovissie expressing concerns with the variance as requested unless the number of units approved by
the Planning Commission is reduced was read for the record. A letter from Jeffery J. Carlson in opposition
to the variance as requested was read for the record.
