Pine Lake Township - Approved With A Condition:
A Conditional Use Permit Appiication (as stated by the Applicant on the Application): The Town
Road Improvement Project will involve the Topographical Alteration of Nitche Lake Road.
The general plan is to widen the existing 24’ grade to a 32’ wide grade within the current
road right-of-way boundary, except for the part of the road between Squaw Point Trail and
450'^ Street. That segment will require a one (1) rod Temporary Construction Easement for
the purpose of constructing a road ditch for proper drainage. The executed Ternporary
Construction Easements required for this work are attached (on file at Land & Resource).
The majority of the fill materials, estimated at 16,000 Cu. Yds., for the grade widening will
be derived from the Pine Lake Township pit located in the SW1/4 SW1/4 12-136-38. The
estimated amount of excavation within the project limits is 3,500 Cu. Yds. Erosion control
practices will be installed with the Pine Lake Township Road Improvement Project prior to
excavation work with permanent turf and mulch measures to be installed within 7 days of
completion. An MPCA NPDES permit has been obtained and the permit applications for
the wetland impacts, confined to the road right-of-way, have been submitted. The project
is located on Nitche Lake Road from CSAH No 53 to N Town Line, Sections 4, 9, 10, 15 &
16 of Pine Lake Township; Big Pine Lake (56-130), GD & Nitche Lake (56-126), NE.
Dave Heyer and Ed Roberts represented the Application.
Motion: A motion by Schwartz, second by Boyer to approve as presented, provided, the
Applicant addresses the comments stated in the May 5, 2010 letter from the Otter Tail
County Highway Department: 1. Coordinate any work that is done within CSAH 53
highway right-of-way with the OTC Highway Department, and 2. If the road approach on
to CSAH 53 is being rebuilt, the Applicant conforms to the OTC Highway Department’s
standard(s). Voting: All members in favor.

based on their application, so the request was to increase from 11 cabins to 30 cabins and the boat
slips would remain unchanged. Andy Leonard (representing East Silent Lake Resort, LLC) stated that
the resort is committed to following the Shoreland Rules. He indicated that there are not always 22
docks put out every year. However, when Planning Commission members completed their site visit,
the docks were on the property and viewed by the members. He also spoke about the favorable
changes being made to decrease the impact on the lake moving the current units back and getting rid
of tarred roads. Neighbor, Jason Gunstenson, expressed his opposition to the expansion because of
the small size of the lake. Don Deiderick also expressed opposition to the proposal. Motion by
Huebsch, second by Erickson, and unanimously carried to approve a Condition Use Permit to
upgrade resort facilities with conditions as recommended by the Planning Commission. The property
is described as Pt GL 1 & 2 ex tracts (46.60 Ac), Section 33, Dora Township: East Silent Lake, (56-
517), RD.
