After discussion and consideration, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a
variance of 10’ from the required road right-of-way setback of 20’ for the placement of 24’ by 24’ garage 10’ from the road right-of-
way and to deny the variance as requested to exceed the maximum height of a non-dwelling structure noting that no adequate
hardship/practical difficulty unique to the property had been shown that would allow for the granting of a variance to exceed the
maximum height requirement and the granting of such a variance would establish a precedence that the Board does not wish to
establish.

Thursday, September 11, 2014
The Otter Tail County Board of Adjustment met Thursday, September 11,2014, with the following persons in
attendance:

Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the August 14, 2014 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
^^/t?ichard A and Linda L Swenson — Approved the requested setback variance and denied the requested height variance. (6:32 p.m.)
Richard A and Linda L. Swenson, Lots 7 and 8, Grand View Heights Kaplers Second Addition, Big Pine Lake in Pine
Lake Township, requested the following: Add a second story storage/scrapbook room, onto existing garage, which is
close to alley. Request to be 10’ from right-of-way and height of 23’. Required setback from the road right-of-way is
20’ and the maximum height of a non-dwelling is 20’. The audience was polled with no one speaking for or against
the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Michael Harris
and unanimously carried, to approve a variance of 10’ from the required road right-of-way setback of 20’ for the
placement of 24’ by 24’ garage 10’ from the road right-of-way and to deny the variance as requested to exceed the
maximum height of a non-dwelling structure noting that no adequate hardship/practical difficulty unique to the property
had been shown that would allow for the granting of a variance to exceed the maximum height requirement and the
granting of such a variance would establish a precedence that the Board does not wish to establish.
Rotenberger Trust - Variance application approved as requested. (6:39 p.m.)
Rotenberger Trust, Lots 3, 4 and vacated road, Comstock Beach, East Battle Lake in Girard Township, requested the
following: Proposing to replace the existing 16’ by 22’ garage and associated concrete totaling 528 square feet with a
24’ by 30’ detached garage placed 4’ from the north property line. Requesting a variance of 6’, required setback is
10’. Ted and Lois Rotenberger appeared at the public hearing. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration. Ward Uggerud made a motion, second by
Thomas Lee and carried with Michael Harris voting no, to approve a variance of 6’ from the required side lot line
setback of 10’ for the placement of a 24’ by 30’ garage 4’ from the side lot line as depicted on the drawing submitted
with the variance application. The proposed development will replace the existing 16’ by 22’ garage and associated
concrete. Hardship/practical difficulty is the location of the mound system and the driveway. It was noted that other
property owners within this immediate area have structure that are just as close to the lot line. It was also noted that
the variance as approved does not directly or indirectly grant any other variances for the proposed development or for
any future development.
Rebecca Dowzak - Variance application approved as requested. (6:48 p.m.)
Rebecca Dowzak, Et Al, Lot 3 and vacated road. Burau Beach and part of Government Lot 1, Section 4 of Dane
Prairie Township, requested the following; Tear down east side entry (10’ by 12’) and east slab (8’ by 12’). Rebuild
east side entry to size of 18’ by 16’ not to move closer to lake. 22’ from ordinary high water level. Cory Reinertson,
Contractor represented the applicant at the public hearing. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Michael Harris made a motion, second by
David Wass and unanimously carried, to approve the requested variance as stated in the application dated August 11,
2014 and has depicted on the drawing submitted with the variance application. The proposed development will be no
closer to the ordinary high water level than the existing house. It was noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development or for any futurg4^elo*ft4t|||^n
