MOTION AS FOLLOWS:
Motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to approve a variance to
subdivide a 2.5 acre parcel and a 2.8 acre parcel from an existing 72.25 acre parcel with the condition that a registered
surveyor’s drawing must be provided and with the condition that no additional variances will be granted to these two
parcels for the placement/location of any structures, wells or septic systems.

Marie Rogers - Approved
Marie Rogers, Perham, MN, requested a variance to subdivide a 2.5 acre parcel and a 2.8 acre parcel from an existing
72.25 acre parcel. Subdivisions containing wetlands or within the shoreland area have a minimum size requirement of 5
acres. The property is described as part of the North Half of the Southwest Quarter, Section 31 of Pine Lake Township.
The audience was polled with no one speaking for or against the request. After consideration, motion was made by
George Walter, seconded by Craig Anderson and unanimously carried, to approve a variance to subdivide a 2.5 acre
parcel and a 2.8 acre parcel from an existing 72.25 acre parcel with the condition that a registered surveyor’s drawing
must be provided and with the condition that no additional variances will be granted to these two parcels for the
placement/location of any structures, wells or septic systems.
Clifford Erickson - Denied
Clifford Erickson, Pelican Rapids, MN, requested a variance to convey a parcel of less than 5 acres without a registered
surveyor’s drawing. The parcel would be approximately 50’ by 105’ by 123’ and would be permanently attached to an
adjacent lake lot owned by Arnold Shirley. The property is described as part of Government Lot 2, Section 27 of Lida
Township by Lake Lida. Charles Krekelberg, Attorney, represented Mr. Clifford Erickson at the hearing. The audience
was polled with Jerry Erickson addressing the request. After consideration, motion was made by John Everts, seconded
by Cecil Femling, to table the variance request for additional information concerning fee ownership of the property in
question. After additional discussion the previous motion was rescind and the following motion was offered by Craig
Anderson, seconded by John Everts and unanimously carried, to deny the variance as requested as the current property
owner was not interested in pursuing either the requested variance or in having the requested variance tabled for
additional information.
Clyde William Millerbernd - Tabled
Clyde William Millerbernd, St. Paul, MN, requested a variance of 9’ from the required top of bluff setback of 30’ for the
placement of a 12’ by 60’ deck 2T from the top of the bluff. The property is described as part of Government Lot 2,
Section 2 of Nidaros Township by East Battle Lake. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to
table the variance request until the April-1997 Board of Adjustment meeting to allow the applicant an opportunity to
consider other building alternatives. The applicant has provided a letter requesting the tabling of his request until the April
1997 meeting. It was noted that since the applicant’s property is currently undeveloped it would be in the best interest of
everyone to consider any alternatives possible that would permit the development of this property without the need for any
variances or at the very least to permit development that would not require a variance from the bluff impact zone.
Ronald E. Werner - Approved
Ronald E. Werner, West Fargo, ND, requested a variance of approximately 55 to 60’ from the required ordinary high water
level setback of 100’ for an addition to an existing dwelling approximately 40 to 45’ from the ordinary high water level. The
property is described as Lot 10, East Shore, Tamarac Lake in Scambler Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson
and unanimously carried, to allow the applicant to use the string line in the shore impact zone for the construction of an
addition to an existing dwelling. Based on the applicant’s testimony the proposed addition will not exceed the string line.
The use of the string line will place the addition approximately 40 to 45’ from the ordinary high water level and will allow the
applicant the ability to enjoy the same rights and privileges as currently enjoyed by the applicant’s contiguous property
owners.

Dear Mrs, Rogers;
Enclosed in the folder are eleven blue line copies of Certificate of Survey
T5122-12 for the survey of three tracts of land along the westerly side of your
property. These tracts are located in the fractional Northwest Quarter of the
Southv/est Quatrter in Section 31-136-38 in Otter tail County, Minnesota. Also
enclosed in the folder is a legal description for each tract, a partial copy of
the original township plat of Pine Lake Township, and a statement for
professional services.
I offer the following comments regarding this survey. We have created these
tracts in accord with your directive. We have set or found survey markers as
shown the small circles on the drawing and have placed a wood lath with orange flagging by each of the markers. We have shown the acreages on the each of the
tracts. These acreages do include a public road easement along their westerly
boundary. At the time you sell one of these tracts you can have your attorney
prepare the necessary deed or contract for deed using the enclosed information.
I would take the entire survey folder to your attorney so that he can use it in
the preparation of the deed. When the deed is recorded in the courthouse a copy of the survey must accompany it. The Otter Tail County Auditor's Office or
Recorder's Office requires a survey copy for their review. You will have to sign
a copy of the survey each time you sell a tract. There is a paragraph on the
survey which states that the tract has adequate access to a public road and that
the tract is large enough for 2 septic systems. Neither of these would be a
problem. You should sign on the line below that paragraph.
The Otter Tail County ordinance requires that tracts if under 5.00 acres
and include wetlands must be platted. Both Tracts B and C include a small amount
of low area. You may have to have the County grant you a variance to sell Tracts
B and C by metes and bounds. You should contact the Land Use Office at the court
house in Fergus Falls to help you in this regard. If the variance is neccessary
they will help you fill out the proper papers.
