(6:58 p.m.) Brian E Schmidt Tst Et Al, part of Government Lot 5 and part of the Southwest Quarter of the Northwest Quarter, Section 32 of Everts Township by Elbow Lake requested a variance of 75’ from the required ordinary high water level setback of 200’ for the placement of a dwelling 125’ from the ordinary high water level. Appearing with the applicant at the public hearing were Rick Leitch and Bruce Lindblom. The audience was polled with Jim Houselog and Darrel Gedde speaking. Mr. Houselog was interested in knowing how this specific request might affect properties closer to his own property. It was noted that each property and each application is unique and given individual consideration. Mr. Gedde spoke in opposition to the variance as requested because he felt it would negatively impact his use of his property for hunting. After consideration and discussion, Michael Harris made a motion, second by Rod Boyer and unanimously carried, to approve a variance of 45’ from the required ordinary high water level setback of 200’ for the placement of a dwelling 155’ from the ordinary high water level. The practical difficulties/hardships are terrain and drainage issues. The granting of the variance as approved will provide the applicant with a reasonable use of his property. It should also be noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. Lunde Trust - Variance application approved as requested. (7:10 p.m.) Lunde Trust, part of Government Lot 2, Section 31 of Fergus Falls Township requested the following: We are requesting to split the property as shown as Parcels A and B. Historically, document number 651151, was a separate parcel. It was included in quit claim deed number 1023952 (Lunde Trust), by mistake, which made it all into one parcel. We are requesting to split the property to keep the 3.20 acre parcel separate. Bruce Fuhrman represented the applicant at the public hearing. It was noted that there will be no change to the existing footprint and that the proposed development will not restrict or obstruct the view from the adjacent properties. MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, April 18, 2013 The Otter Tail County Board of Adjustment met Thursday, April 18, 2013, with the following persons in attendance: Thomas Lee Rick Wilson Michael Harris Steve Schierer Paul Larson Ward Uggerud Scott Ellingson, Land and Resource Management Kurt Mortenson, County Attorney Called to Order - Steve Schierer, Vice Chair called the meeting of the Board of Adjustment to order at 6:27 p.m. Minutes Approved - The Board of Adjustment approved the minutes of December 6, 2012 meeting as mailed. Chair and Vice Chair Selection - Steve Schierer, 2012 Vice Chair, called for nominations for Chair and Vice Chair of the 2013 Board of Adjustment. Paul Larson made a motion, second by Michael Harris and unanimously carried, to direct the Secretary of the Board of Adjustment to cast a unanimous ballot for Steve Schierer as Chair and for Thomas Lee as Vice Chair of the 2013 Board of Adjustment. Steve Schierer requested the secretary send a thank you on behalf of the Board to Randall Mann for his past service. The Board of Adjustment considered the following applications for variance: Judy Steffes - Approved the variance application as requested. (6:31 p.m.) Judy Steffes, Lot 2 Morningside Beach, Pelican Lake in Dunn Township, requested the following: Requesting a 40' variance from the ordinary high water level setback of 75’ to connect 2 existing dormers. The proposed new dormer will be 35’ 4” from the ordinary high water level. No changes to the existing structure footprint will be made. This variance will allow the existing structure to tie into new construction with a continuous roofline, improving the lake views while matching the architectural design of the entire structure. Hardship is the substandard location of the existing structure. The audience was polled with on one speaking for or against the variance as requested. After discussion and consideration, Thomas Lee made a motion, second by Rick Wilson and unanimously carried, to approve the variance as requested in the variance application dated November 27, 2012 and as depicted on the drawing submitted with the application. The practical difficulty is a substandard lot of record. It was noted that the proposed development will not be any closer to the ordinary high water level than the existing structure. It was also noted that after completion of the proposed project the applicant will not exceed the allowable impervious surface coverage. The proposed development does change the existing roofline.
