After discussion and consideration, Paul Larson made a motion, seconded by Thomas Lee and unanimously carried, to approve
the proposed subdivisions as described in the variance application dated August 16, 2017 with the following conditions: 1.) each
of the proposed lots must have at least 20,000 square feet of area, 2) a registered surveyor’s drawing must be provided at the time
of conveyance and 3.) the ownership issues must be resolved. It was noted that the Board of Adjustment does not resolve

Gary A. and Linda L. Layman, Lot 2 Sumiy Beach Resort, Little Pine Lake in Gorman Township, requested the following:
Proposing to construct a 15’ by 25’ addition to the dwelling being approximately 55’ from the ordinary high-water level. The
required setback is 75’. The audience was polled with no one speaking for or against the variance as requested. Letters from
Marcia Nelson, Ken Ki'ajsa, Doug Stromberg and Tim Buss in support of the variance as requested were read for the record.
After discussion and consideration, Thomas Lee made a motion, seconded by Paul Larson and unanimously carried, to approve a
variance of 20’ fiom the required ordinary high-water level setback of 75’ for the placement of a 15’ by 25’ addition to the
existing dwelling 55’ from the ordinary high-water level with the condition that no more than 25% of the total eligible lot area can
be covered with impervious surfaces. It was noted that the proposed development is on the side of the existing dwelling and
behind the lakeside of the existing dwelling. The variance as approved does not directly or indirectly grant any other variances
for the proposed development or for any future development.
Solveig Halbakkcn Living Trust - Variance application approved as requested. (7:36 p.m.)
Solveig Halbakken Living Tmst, Lot 6 Camp Nidaros, Otter Tail Lake in Amor Township, requested the following: We are
asking for a variance to the lot line setback fiom 40’ to 25’ for a water oriented accessory structure. With this variance the
proposed gazebo will be less visible from the lake as well as Otter Tail County Highway 1. Placing the gazebo as proposed will
place it in such a way that vegetation will screen it on the north and east side throughout the late spring through late fall.
Additionally, the neighboring property to the north-east has a garage with a side wall approximately 40’ from the lot line
screening the living quarters fi'om view. The proposed gazebo’s placement will not interfere with the neighbor’s view or access
to the lake. There is an existing water oriented accessory structure, it will be removed, it was damaged by ice. The audience was
polled with no one speaking for or against the variance as requested. After discussion and consideration, Darren Newville made a
motion, seconded by Loren Bailey and unanimously carried, to approve the variance as described in the variance application
dated August 6, 2017 and as depicted on the drawing submitted with the application. It was noted that the proposed development
is an improvement to the property as the proposed structure will be further from the lot line and from the ordinary high-water
level. The proposed location does not restrict view from neighboring properties. The variance as approved does not directly or
indirectly grant any other variances for the proposed development or for any future development.
Cathy Powers - Variance application approved as requested. (7:40 p.m.)
Cathy Powers, Lot 5 Block 1 Patterson Acres, Big Pine Lake in Pine Lake Township, requested the following: Proposing to
enclose 8’ by 13’ outdoor walkway into indoor space. Exterior wall and roof to be in line with existing wall and roof structure of
current house. Per phone conversation with Cathy the proposed enclosure will be 22’ from top of bluff. Asking for an 8’
variance. The audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Thomas Lee made a motion, seconded by Paul Larson and unanimously carried, to approve an 8’ variance fi'om the
required bluff setback of 30’ for the enclosure of the existing 8’ by 13’ outdoor walkway into indoor living space located 22’ from
the bluff as described in the variance application dated August 8, 2017 and as depicted on the drawing submitted with the
variance application. It was noted that the enclosed area will be no closer to the bluff than the front of the existing house. It was
also noted that three of the four walls needed to enclose this area already exists. It was strongly encouraged that the applicant
consider the placement of gutters to direct the water away from the bluff. The variance as approved does not directly or indirectly
grant any other variances for the proposed development or for any future development.

indicating landownership issues. After discussion and consideration, Paul Larson made a motion, seconded by Thomas Lee and
unanimously cairied, to approve the proposed subdivisions as described in the variance application dated August 16, 2017 with
the following conditions: 1.) each of the proposed lots must have at least 20,000 square feet of area, 2) a registered surveyor’s

STATEMENT OF EVIDENCE:
SE CORNER GOVERNMENT LOT 4, SECTION 4, TOWNSHIP 136, RANGE 38
The following offices were utilized in gathering information concerning this comer:
Otter Tail County Recorder’s office
Otter Tail County Auditor’s office
Otter Tail County Highway Department
MeadowLand Surveying
Moore Engineering and Surveying
Compass Consultants
Files and records of Anderson Land Surveying, Inc.
In August of 2016, a crew from Anderson Land Surveying, Inc., of Fergus Falls,
Minnesota, set the southeast comer of Government Lot 4 in conjunction with a survey
performed in said Government Lot 4.
The position was established by measuring 1320 feet westerly of the Southeast comer of
Section 4 as the south line of Section 4 was mn only to Meander Comer No. 10, which
fell approximately 110 feet out into Big Pine Lake.
This position is supported by the half section mapping for the South half of Section 4, a
Certificate of Survey prepared by Robert Oslund on August 17,1982, recorded as Doc.
No. 1058239, a Cen:ificate of Survey prepared by Robert Oslund on June 30,1997,
recorded as Doc. No. 1058236 and a Certificate of Survey prepared by Roy Smith on
August 22, 1996, recorded as Doc. No. 1058237.
This position is not supported by a Certificate of Survey prepared by Roy Smith on
August 20, 1999, recorded as Doc. No. 1058384.
Inquiries to MeadowLand Surveying, follow up communications and exchanges of
information did not lead to a satisfactory explanation as to why the 1” x 1” shaft should
be accepted as the southeast comer of Government Lot 4.

Minnesota.
