The two choices are: To remove the addition and avert prosecution or to be prosecuted and following the dis­ position of the prosecution to obtain a valid variance from the Otter Tail County Planning Commission. There is no guarantee that the Planning Commission will grant the variance, jf the variance request is denied the addition would still have to be removed. Wilson Your Pile No. 79 After an on-site investigation I found the addition to be approximately 12 foot from the high water mark when it should be 75 feet. Due to the followintg ,fects, that Shoreland Management Zoning has been in effect since 1971 and that the owner had secured a sewage system permit and a local carpenter was hired, I find it bard to justify the owner not first obtaining a legal building permit, The addition itself is no closer to the high-water mark than the existing dwelling and is not what I would term an obnoxious structure, therefore, I would suggest that if the owner is willing to remove the addition, that the violation be voided, I would further suggest that if the o;^ner is not agreeable to this condition, that a violation be prosecuted and the owner be required to obtin a valid variance from the Otter Tail County Planning Advisory Commission.
