42, West Red Riyer) with conditions as recommended by the Planning Commission.
Applicant, Augie Strieker, questioned condition No. 1 of the Planning Commission minutes referring to
residential construction being completed without variances and whether future property owners can be
preempted from requesting a variance. The County Attorney stated that the Board of Adjustment is not
bound by this condition.

Elder Engebretson (Sec. 22, Twp. 133, R. 43, Unnamed Lake-56-862) with conditions as recommended by
the Planning Commission.

Motion by Portmann, second by Lee, and unanimously carried to uphold the denial of the Planning

A Preliminary Plat of "K & K Beach" consisting of 3 residential
lots and 1 block.

GD.
The property is described as Pt. of Gov. Lot 5
Clem Hendrickson (Surveyor, Anderson Land Surveying) represented
the Preliminary Plat. Ordean Huus expressed concerns as to just
where this proposed plat is located; Arlan Sletten indicated that
he does not wish to see the wetlands developed; Dick Abramson
expressed concerns regarding the wetlands (the area is very wet)
and also indicated that over the last couple of years there has
been a considerable change in the shoreline (loss of vegetation)
and was concerned platting this area would increase this change
even more and requested a denial; Verlin Menze (Chairman, Aurdal
Townboard) indicated that he would be available to answer any
questions that the Planning Commission may have of the Township
and also indicated that the 3 major issues discussed (wetlands,
drainage & possible locations of approaches) are sufficient
grounds to deny the request.
Motion;A motion by Zimmerman, second by Trites to deny, reasons
as follows: 1. Marginal building sites. 2. The wetlands onsite
appear to be larger than shown on the preliminary plat map. 3.
There does not appear to be sufficient area/elevation for the
installation of onsite wells and/or sewage systems,
drainage culvert should be left open. 5. Access to Old Hwy 210 is
questionable. 6. This is not the best use of the land.

The Commission took a 5 minute break at 8:20.Break;
Daniel & Cheryl Barry - Approved As Presented;
A Conditional Use Permit Application to construct a driveway for
a building site. Approximately 1200 to 1500 cubic yards are to
be reshaped. Request to do the project this fall. The property
is described as Gov. Lot 1, SEl/4 NEl/4 & NEl/4 SEl/4 Ex Tr & Pt
Gov. Lot 5, Section 4 of Maine Township; Duck Lake (56-483) , GD.

provided the pool and the pool house be relocated to meet the

Robert Olson - Denied:
A Conditional Use Permit Application to fill an area in back of
ice ridge of approximately 10 feet above lake elevation. Area to
be filled is approximately 24,000 square feet to a depth of 4
feet - approximately 3500 cubic yards. Fill will be sloped and
graded down to the lot line to the south. The property is
described as Cozy Cove SubDivision-Heinrich Bch - E 326.5' of
Outlot B (1.6 Ac) in Section 2 and Lot 5 in Section 1 of Dead
Lake Township; Marion Lake (56-243), GD.
Clem Hendrickson (Surveyor, Anderson Land Surveying) represented
the Application.
A motion by Estes, second by Trites to deny, reasonMotion;
being this request is an inappropriate use of this land as it is
a wetland and a filter basin.
Voting; All members in favor.
