Duit, Staples, MN, requested a variance of 3’ and a variance of 2’ from the required side lot line setback of 10’ for the placement of a dwelling 7’ from the west side lot line and 8’ from the east side lot line, a variance of 7' from the required side lot line setback of 10’ and a variance of 3’ from the required holding tank setback of 10’ for the placement of a 24’ by 28’ garage 3’ from the east side lot line and 7' from the holding tank. Trader, Fargo, ND, requested a variance to allow the present location of a holding tank beneath the end of an enclosed carport. The required setback is 10’. “This is a second request that an approved holding tank be allowed to remain in its present location. The tank was less than 10’ from an existing garage when it was installed. A carport was built over the buried tank and approved by Otter Tail County. The carport has now been enclosed. (1) prevention of soil erosion or other possible pollution of public waters, both during and after construction; (2) limiting visibility of structures and other facilities as viewed from public waters; and (3) adequacy of the site for water supply and on-sita sewage treatment; and an assessment of the types, uses, and numbers of watercraft that the project will generate in relation to the suitability of public waters to safely accommodate these watercraft. B. Local governments may impose conditions when granting conditional use permits that specify: public waters; vegetation allowed to be removed or required to be established; sewage treatment system location, design, or use; location, design, and use requirements for watercraft launching or docking, and for vehicular parking; structure or other facility design, use, and location; phasing of construction; and other conditions considered necessary by the , local unit of government. increased setbacks from Subp. 4. Local governments must require upgrading or replacement of any existing, on-site sewage treatment system identified as a nonconformity under a program established under part 6120.3400. Systems installed according to all applicable local shoreland management standards adopted under Minnesota Statutes, section 105.485, in effect at the time of installation may be considered as conforming unless they are determined to be failing, except that systems using cesspools, leaching pits, seepage pits, or other deep disposal methods, or systems with less soil treatment area separation above groundwater than required by chapter 7080, shall be considered nonconforming. All nonconformities other than on-site sewage treatment systems must be managed according to applicable state statutes and local government official controls. B. Subp. 4a. Shoreland management by townships. Townships may adopt shoreland management controls under authority of Minnesota Statutes, section 394.33, subdivision 1, if the controls are not inconsistent with or less restrictive than the controls adopted by the county in which the township is located. Thon and Kimberly J. Thon RE: Gentlemen: I represent my brother Stephen W. Shure and myself, concerning the attached Notice of Hearing for Variance, previously owned by Lyra L. Shure on Little Pine Lake. We own a home We contest the request for a variance for many reasons, among them being: the land on or near the requested variance has a high water table, most the homes nearby on the Lake were required to install holding tanks; and it is questionable whether or not the requested building sites could comply with Minnesota Statutes Annotated Section 115.55 requiring a legal separation from water table to the bottom of septic system. The law was changed, as I understand it, in July of 1997 requiring a Three (3) lot separation between water table and bottom of the septic system. Section 6120.3900 of the Standards for Management of Shoreland Areas states variances may be granted in accordance with Minnesota Statutes, Chapter 394 or 462 as applicable, considering variance requests, boards of adjustment must also consider whether existing sewage treatment systems on the properties need upgrading before additional development is approved. In See enclosure Exhibit A. In addition, a thorough evaluation of the topographic vegetation and soils condition on the site should be made to ensure: (1) prevention of erosion or other possible pollution of public waters, both during and after construction; (2) limiting visibility of structures and other facilities as viewed from public waters and (3) adequacy of the site for water supply and on—site sewage treatment. In conclusion, it would appear that the granting of the requested variance would not be in the public's best interest, and to be granted it should be shown that the variances are not being ,«a.; 1 D’ ‘-.-i ii '<J !«..
