Frank and Esther Kara, Pelican Rapids, MN, requested a variance to allow Lot T and Lot U, which have the same ownership and are contiguous, to remain as individual lots even though they do not meet the minimum requirements of the shoreland ordinance and according to the present ordinance are considered one lot for the purposes of development and conveyance. The property is described as Lot T and Lot U of Government Lot 7, Poss Survey Lots, Lake Lizzie in Dunn Township, Appearing along with the applicant at this hearing was Stephen Kantrud, Realtor, This request had been tabled at the July 9th, 1992 meeting. At the August 6th, 1992 meeting the following motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to deny the variance as requested with the provision that If legislation, court action or a DNR policy change, etc. results In an ordinance change or a different Interpretation of the existing ordinance the applicants will be allowed to bring their request back to the board for reconsideration after proper notification Is given with no additional fee being charged to the applicants. At the October 1st, 1992 meeting the applicant requested that the Board of Adjustment reconsider their request due to the fact that the Department of Natural Resources has stated In a letter to them that the ordinance requirements were not Intended to apply to structures already existing, but rather the situation where a new structure Is being considered. It was the opinion of the board members that since the request was the same and no change has been made in the ordinance and no hardship exists It would not be appropriate for the Board of Adjustment to act on this request at this time. AudHor SEP August 31, 1992 Otter Tail County Board of Adjustment c/o Courthouse Fergus Falls, Minnesota 56537 Re: Variance Application Greg and Carla Gauwitz Dear Sirs; I would like to inform you that we will not be at the meeting on Thursday September 3, 1992. Our variance application was tabled for further dis­ cussion at the board meeting held on August 6, 1992. At this point, we will no longer seek s variance for this property. We were very disappointed at the outcome of our meeting with you in August. Not so much in your decision to table the issue for further discussion, but rather the fact that the county attorney encouraged that decision. When we originally looked into dividing this property in the summer of 1991, I was made aware of the new regulations pertaining to resorts (the tier system). At that time, we realized that we did not have enough property to divide off the upper lot and continue to operate the resort as such. When I approached the personnel in Shoreland Management this July (92) to see if anything had changed, Pat checked with his supervisor and the County Attorney's office and informed me that it was possible that the Board of Adjustment could approve the split and allow the resort to continue to operate as is. At the meeting we attended on August 6, we really felt that the attorney for the county was encouraging the board to stick closely to the new regula­ tions. Had we been aware that would be the case, we would have saved our­ selves the variance application fee of $45.00 and everyone's time involved in researching the application. We were fully aware of the new guidelines regarding the resort before w? ever applied for this variance. At this point, the entire process has been only a waste of time and money, and to continue to pursue it, I feel, would only be more of a waste. Thank you for your consideration. Sincerely, Carla E. Richard Hagemelster and Llnnea William - Approved Richard Hagemelster and Llnnea William, Battle Lake, MN, requested a variance of approximately 10' from the required 30' structure setback from the top of a bluff for the construction of a 1,600 square foot addition to an existing cabin. The property is described as a part of Sub Lot 1 of Government Lot 2, Section 23 of Amor Township on Otter Tail Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts seconded by Cecil Femling and unanimously carried, to approve a variance of approximately 1 O’ from the required 30’ structure setback from the top of a bluff for the construction of an addition to an existing cabin that will be no closer to the lake than the existing structure and the applicant’s proposed plan does not impact the bluff zone adversely. The drainage is away from the bluff and only one corner of the building (approximately 100 square feet) will be within the bluff impact zone area. The addition is above the bluff on the flat area and the drainage is away from the bluff Impact area and will not create the problems that the ordinance is trying to avoid.
