MINUTES APPROVED-September 1st. 1994 Hearing no corrections or additions the minutes of the September 1 st, 1994 meeting were declared approved as mailed. The following variance requests-’were heard; Lois Agather - Approved Lois Agather, Fargo. ND. requested a variance of 5’ from the requiredside lot line setback of 10' and a variance of 1 O' from the required road right-of-way setback of 20' for the replacement of an existing 14' by 25' garage with a 20' by 26' garage 5’ from the west lot line and 10' from the road right-of-way. The property is described as the West 75 of East 225' of N 150' of Government Lot 3. Section 2 of Per ham Township on Little Pine Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to approve a variance of I O' from the required road right-of-way setback of 20' and to deny the requested west side lot line variance of 5'. Hardship being a substandard lot of record. It should be noted that the road is an easement road. George R. Milligan - Approved George R. Milligan, St. Paul, MN, requested a variance of 1 O' from the required road right-of-way setback of 20’ for the construction of a garage 10' from the road right-of-way. The property is described as Lot 6. Parkdale Beach, Swan Lake in Dane Prairie Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a variance of 10' from the required road right-of-way setback of 20' for the construction of a garage 1 O' from the road right-of-way with the conditions that the entrance to the garage will be at a right angle to the highway and that the existing 8' by 16’ shed will be removed. Hardship being a substandard lot of record. Ssptember 8th, 1994 Page 2 Eugene Bierne - Approved Eugene Bierne, Ottertail, MN, requested a variance to permit 17 overnight mooring sites. The shoreland ordinance would allow for 10 overnight mooring sites. Applicant is requesting an additional seven overnight mooring sites which will provide one site for each of 1 7 cottages. The property is described as Lot 2, Greenwood Resori, Otter Tail Lake in Otter Tail Township, hr. Chuck Anderson represented the applicant at the hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a variance that would permit 17 overnight mooring sites and two docks. The granting of the variance will be an improvement over the existing situation. It should be noted that the property is being transferred from a resort to a cluster development. j 33 73 Mary J. Jahoda - Tabled Mary J, Jahoda, Moorhead, MN, requested a variance of 80' from the required ordinary high water level setback of 100' and a variance of 30' from the required shore impact zone setback of 50' for the placement of a cabin 20' from Gizzard Creek, a variance of 57' from the required ordinary high water level setback of 100' and a variance of 7' from the required shore impact zone setback of 50' for the placement of a cabin 45' from Clitherall Lake, The property is described as part of Government Lot 4, Section 1 1 of Clitherall Township on Clitherall Lake and Gizzard Creek. The audience was polled with Richard Peterson speaking to the request, After consideration, motion was made by Cecil Femling, seconded by Randall Mann to deny the variance as requested. The motion failed with Craig Anderson. John Everts and George Walter voting no. After additional consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to table the variance request untiljhe October 6th, 1994, Board of Adjustment meeting for additional information, it was noted that the applicant's property is in an environmentally sensitive area. iJEdward J. Schlichting - Approved Edward J. Schlichting, Anoka, MN, requested a variance of 125' from the required ordinary high water level setback of 200' and a variance of 25' from the required shore impact zone setback of 100' for the construction of a dwelling 75' from the ordinary high water level. The property is described as Lot 7, Minnkota Beach 2nd Addition, Dead Lake in Maine Township. Letters from Lois Bapp and Raymond Rau were read for the record. The audience was polled with no one speaking for or against the request, After consideration, motion was made by George Walter, seconded by Randall Mann and unanimously carried, to approve a variance of 11 O' from the required ordinary high water level setback of 200' and a variance of 10' from the shore impact zone setback of 100' for the construction of a dwelling 90' from the ordinary high water level. ■f ; David C. Martinson - Denied David C. Martinson, New Hope, MN, requested a variance of 5' from the required side lot line setback of 10' for the placement of a proposed utility shed 5’ from the side lot line. The property is described as Sub Lot T of Government Lot 1, Section 1 1 of Scambler Township on Pelican Lake, Appearing at the hearing with the applicant was James E. Dalos. The audience was polled with no one speaking for or against the request. Dear Tim, L I talked with Tom Schepper and he said he planned to use block to raise the garage 24 inches and fill it 16 inches with sand and a new floor. I have a signed permit from Merle Walk giving me permission to add fill between the road and garage according to your specifi­ cations . The road is on Merle Walk's property with an easement so the Township Clerk said by phone that they had no say over it. just do the maintenance on it. They I hope to be at the lake next week Tuesday and then the rest of the week if you need to contact me.346-3087.
