The property is located on Co Hwy 8, Section 02, Township 136, Range 39 in Perham Township. The purpose of this evaluation was to determine if there are suitable soils on this parcel for construction of onsite septic systems for single family homes should the parcel be divided; the proposal would be 2 lots as per drawing (parcel A 8l parcel B) provided by Compass Consultants land surveying. I conducted soil borings on each of the proposed lots to determine the type of soil and the depth to the restricting layer as it pertains to onsite septic systems. The soils on the property are of loamy sand top soils with sand subsoils. Rock Fragmentation is less than 5%. The depth to the restricting layer was 84 inches on the proposed lots. These soils would allow a standard type I septic system to be installed on each lot. An area of 500 square feet was staked on parcel A lot (existing house lot 4 bedrooms) and an area of 5000 square feet was stake on parcel B lot as required by Otter Tail County. These areas are not exclusive of the area suitable for a septic system on each lot. They are simply an area that is suitable and not to be disturbed. As with any proposed construction, it is advised to consult a septic system designer before making any final decisions regarding the placement of a dwelling, non-dwelling or a well on the property. When we purchased this property in 1983 it included over 6 acres stretching from County Hwy 8 all the way north to Little Pine Lake. Bruce and Barbara Kiefer had a camper on their parcel. As time went on, Bruce and Barb built a year round home, we bought out our business partner, eliminated the resort on the lake, moved our home from the property on the highway to the lake lot, resurveyed to allow sale of our lot on the highway, etc., etc. Each time we did anything, because we respected compliance in the processes put into place, we applied for permits as appropriate with Land and Resource Management. When Bruce was going to build this garage in 1992, my husband, Greg (now deceased), discussed with him property line encroachment related to where Bruce intended to place the original building. Bruce chose to place the building where he wanted rather than where it should have been. A few years later, the original garage burned down and once again, Greg discussed with Bruce the necessity of the garage being moved to correctly accommodate the property lines. Once again, the garage was placed incorrectly (to ‘use the existing slab’). I do not know how this came to be with site applications although I do remember Bruce always alluding to the fact that he was not within Land and Resource jurisdiction, a statement we never quite understood as our property located on Hwy 8 always was within that jurisdiction. Enter 2020. I spoke with Katie and let her know of this problem as their family estate plan is to sell the Kiefer property. After encroachment on the property line being ignored for all these years, I wanted her (along with the new owners being informed) that there is no room on the west side of the garage to allow storage of items as anything placed there will end up on my property. I and/or my family should not need to be responsible for that when/if my property is sold. Yet, there seems no way to protect me in even in this request, having this same conversation with new owners of other properties surrounding mine has accomplished nothing to this point. Other than that, what can I do? To put it simply, avoiding a financial hardship for the Kiefers results in further encroachment for me. I am disappointed in previous processes that allowed this to happen in the first place. That being said, I will not stand in the way of this variance being approved. Since moving to Little Pine Lake in 1983, we (now I) have been disappointed in multiple instances of neighbors being inconsiderate of property lines. It truly does seem that ‘nice guys finish last’.
