After consideration and discussion, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a
variance of 40’ from the required ordinary high water level setback of 200’ for the placement of the proposed development 160’
from the ordinary high water level. It was noted that the proposed location will not obstruct the view from the adjacent properties.
The variance as approved does not directly or indirectly grant any other variances for the proposed development or for any future
development.

Daniel and Tonya Zierden - Denied. (6:53 p.m.)
Daniel and Tonya Zierden, part of Government Lot 3, Section 31 of Maine Township by West Lost Lake, requested
the following:
1. Lot to be declared buildable for residential and non-residential structures.
2. 75’ variance for setback from the ordinary high water level for structures. Being 125’ back from ordinary
high water level, required setback is 200’.
3. 25’ variance for septic from ordinary high water level. Being 125’ back from ordinary high water level,
required setback is 150’.
The audience was polled with Richard L. Pemberton, Randy Wasvick, Bruce and Lois Wenger and Mary Worner
expressing concerns with the variance as requested. Letters from Mary Worner and Richard L Pemberton in
opposition to the variance as requested were presented for the record; however, they were not read because both of
these individuals were in attendance and spoke on their own behalf. After lengthy discussion and consideration,
Thomas Lee made a motion, second by Ward Uggerud and carried with Michael Harris and Paul Larson voting no, to
deny the variance as requested as no adequate hardship/practically difficulty unique to the property had been shown
that would allow for the granting of the variance as requested, noting that the applicants were aware when they
acquired the property that it was classified as a non-buildable lot, and the water on two sides and the placement of the
easement road does not provide an adequate area for development. A reasonable use of this property does not
provide for the placement of a structure on this particular property.
Michael and Andrea Tauer- Application approved as requested. (7:50 p.m.)
Michael and Andrea Tauer, Lot 18 and part of Lot 19, Lenius Beach First Addition, Little McDonald Lake in Edna
Township, requested the following; I am proposing to replace the upper deck on the existing cabin and expand the
sides of the deck 2’ out farther to accommodate a table and chairs. The deck is approximately 65’ from ordinary high
water level. I would like to replace the lower deck with pavers as approved under the conditional use permit. I would
like to reconfigure the steps and replace the existing lake side deck the same size and location. The audience was
polled with no one speaking for or against the variance as requested. After consideration and discussion, Thomas
Lee made a motion, second by Paul Larson and unanimously carried, to approve the variance as requested in the
application dated June 17, 2014 and as depicted on the drawings submitted with the variance application. The
proposed project is basically maintenance to the existing deck.

Scott D and Kelli A Hoffman, part of Government Lot 2, Section 20 of Parkers Prairie Township by Clarno Lake,
requested the following; Due to the unknown changes to the road and right-of-way of County Highway 38, we are
asking for a variance of 40’ inside the current 200’ setback from the ordinary high water level. We are requesting this
variance for the safety of our family and property after the construction of our new home and reconstruction of County
Highway 38. The audience was polled with no one speaking for or against the variance as requested. A letter from
the Otter Tail County Highway Department was read for the record. After consideration and discussion, Paul Larson
made a motion, second by Michael Harris and unanimously carried, to approve a variance of 40’ from the required
ordinary high water level setback of 200’ for the placement of the proposed development 160’ from the ordinary high
water level. It was noted that the proposed location will not obstruct the view from the adjacent properties. The
variance as approved does not directly or indirectly grant any other variances for the proposed development or for any
future development.

RE: Variance for Residential Construction
CSAH No. 38, Section 20, Parkers Prairie Township (T131N-R37W)
Dear Wayne:
We have reviewed this request and have the following comments relative to CSAH No. 38:
1. As shown on the applicant’s drawing the existing CSAH No. 38 right of way is 50 feet
from the highway centerline at this location.
2. We do not anticipate realignment of the highway centerline at this location.
3. With the proposed reconstruction scheduled for 2015 we would propose to expand the
right of way width to 60 feet either side of the highway centerline. An increase of 10 feet.
4. As the property is within 1,000 feet of a lake the setback from the highway right of way
would be 20 feet. This would limit any permanent construction within 80 feet of the
highway centerline.
5. With the proposed reconstruction there may be the need for temporary construction
easements beyond the new proposed 60 foot right of way. Based on the proposed plans,
we anticipate that the temporary construction easement at this location would not exceed
30 feet. This would put the limits of any proposed work out to 90 feet from the centerline
or less. This is a temporary use. Once construction is complete the temporary easement
area reverts back to the property owner.
6. Thus based on the above, we do not see where our involvement on the property would
extend beyond 90 feet from the existing highway centerline or 40 feet from the existing
right of way. This is far less than the 160 foot setback from the right of way line
requested by the applicant.
7. The applicant will need to complete an Application for Approach and submit it to the
Otter Tail County Highway Department for the proposed future approach, if it is not
constructed as part of our reconstruction project.
